Pilot and replicate at least 2 effective legal support models for businesses

Recently, Deputy Prime Minister Tran Luu Quang signed Decision 345/QD-TTg approving the Project "Improving the quality and effectiveness of legal support for enterprises in the period 2021-2030".

The project identifies specific objectives: Completing the legal framework on legal support for businesses; striving for 100% of legal regulations on businesses, rights and obligations of businesses to be promptly and fully informed to businesses; strengthening training and updating legal knowledge for businesses and those working in legal support for businesses.

Effectively operate the legal consultant network system; continue to build and complete the database of cases and legal problems for businesses; ensure that 100% of businesses receive legal support when requested; resolve and remove legal problems and difficulties for businesses when requested.

Pilot and replicate at least 02 effective legal support models for businesses nationwide; apply digital transformation in legal support for businesses; build an ecosystem of legal support for businesses in 63 provinces and centrally run cities.

Along with that, from 2024 to 2027, the Government assigned the Ministry of Justice to preside over the implementation and replication of a number of effective and practical legal support models for enterprises, including the following activities: Selecting a number of localities to build and develop pilot models of legal support for enterprises; organizing a summary and drawing experience from the implementation of legal support models for enterprises in a number of localities; combining ministries, ministerial-level agencies, and localities to synchronously implement legal support models for enterprises in 63 localities nationwide.

Completing the legal framework on enhancing legal support activities for businesses

One of the tasks and solutions of the Project is to perfect policies and laws on legal support for enterprises. Specifically, perfecting the legal framework on enhancing legal support activities for enterprises; reviewing and proposing to perfect relevant legal provisions to remove legal obstacles for enterprises; studying foreign experiences on legal support for enterprises to improve the quality and effectiveness of legal support for enterprises in Vietnam.

In particular, the Ministry of Justice presides over the research and evaluation of the implementation results of Decree No. 55/2019/ND-CP dated June 24, 2019 of the Government on legal support for small and medium-sized enterprises, thereby proposing amendments and supplements to a number of regulations to mobilize the direct participation of business representative organizations, legal service organizations and independent experts in legal support activities for enterprises; perfecting the legal basis for implementing new legal support activities, encouraging innovation.

Completing Decree No. 55/2011/ND-CP dated July 4, 2011 of the Government regulating the functions, tasks, powers and organizational structure of legal organizations (in the direction of enhancing responsibility, focus, and specialization of legal support activities for enterprises; regulating the functions, tasks, powers and organizational structure of legal organizations of Decree No. 55/2011/ND-CP).

Ministries and ministerial-level agencies in their specialized management fields shall review legal regulations to remove difficulties and obstacles for enterprises in production and business activities; strengthen surveys and promptly dialogue with enterprises to accurately and accurately identify legal difficulties and obstacles to propose legal improvements and improve the effectiveness of law enforcement related to enterprises.

Every year (from 2023 to 2030), the Ministry of Justice, the Ministry of Planning and Investment, the Ministry of Finance, and provincial People's Committees will increase the socialization of legal support activities for businesses. Specifically, increase the socialization of legal support for businesses according to the provisions of law; encourage organizations representing businesses, businesses, and individuals to participate in supporting and implementing projects, programs, and activities to provide legal support for businesses.
