Overall 'design' for Vietnam's legal system in the new context

(Chinhphu.vn) - In addition to amending each specific law, we need to have a comprehensive and overall view of the legal system; there needs to be an overall "design" for the Vietnamese legal system in the new context, clearly identifying the necessary pillars to meet the country's development goals in the next 100 years.

On the afternoon of October 3, Minister of Justice Nguyen Hai Ninh chaired a meeting with members of the Prime Minister 's Policy Advisory Council on the Project "Improving the structure of Vietnam's legal system to meet the requirements of national development in the new era".

Speaking at the meeting, Minister Nguyen Hai Ninh said that our country is in a very special period. We are carrying out a revolution in streamlining the local government apparatus, amending the Constitution and innovating the thinking of law-making with the issuance of Resolution 66-NQ/TW. In addition, the Politburo has also issued many other important resolutions on digital transformation, international integration and private economic development.

It can be said that a series of new viewpoints and policies of the Party have been issued, both inheriting previous achievements and having breakthroughs. Therefore, the rapid translation of these policies into laws and concrete actions requires the work of building legal institutions to be comprehensively innovated.

The Minister of Justice shared that the workload is enormous. Never before have we had to develop such a large volume of legal documents at such a fast pace. This is both an inevitable requirement of political tasks and a requirement of practical life. Our legal system has been built over many years and has made an important contribution to the country's socio-economic development.

However, the Minister emphasized that Resolution 66 has pointed out that the legal system still has many limitations and shortcomings. Therefore, we are forced to change, amend, and issue new documents to overcome these bottlenecks. Moreover, Resolution 66 also requires that the law must create a solid foundation and even lead development, becoming a competitive advantage. This is a very high requirement. We must both overcome shortcomings that have existed for many years and meet new requirements of development.

According to Minister Nguyen Hai Ninh, the National Assembly, the Government and the ministries and branches have been making every effort. The workload at the upcoming session of the National Assembly is extremely large, with about 50 laws and resolutions expected to be submitted, and possibly even more to be added.

As an "insider", Minister of Justice Nguyen Hai Ninh affirmed that the issuance of many legal documents in a short period of time is very necessary. However, the Ministry of Justice is also very concerned about ensuring the consistency and systematicity of the law.

Therefore, in addition to amending each specific law, we need to have a comprehensive and holistic view of the legal system. We need to have an overall "design" for the Vietnamese legal system in the new context, clearly identifying the necessary pillars to meet the country's development goals in the next 100 years.

"This is a very big task. With the proposal of the Ministry of Justice, we have organized many seminars, studied international experiences and found that there are many things worth learning," the Minister stated clearly and hoped that it would be necessary to amend and supplement the law to meet immediate requirements but also have a long-term vision, a complete structure for the legal system to ensure consistency, stability, and meet the country's development goals.

At the working session, experts contributed many profound opinions to the draft Project to build a system of institutions and laws that strongly arouse patriotism and the desire to develop the country, unleash and liberate all resources, promote all motivations; turn institutions and laws into international competitive advantages to realize the country's development goals by 2030 and 2045 (by 2030, Vietnam will be a developing country with modern industry and high average income; by 2045, Vietnam will become a developed country with high income following the socialist orientation).

According to experts, the legal system must be reasonably designed in both content and structure, ensuring the dialectical relationship between elements in the legal system (especially between legal fields, between substantive law and procedural law, between sectors, legal institutions and norms, between types of legal sources); ensuring the necessary stability to increase predictability for people and businesses in the face of legal changes to promptly adapt, while having the necessary openness and flexibility, anticipating the future to make it easy to comply and easy to implement.

This can only be achieved through calculating and designing a more reasonable legal system in the direction of fully and promptly institutionalizing the Party's policies on national development orientation in the new era; at the same time, clearly defining the design principles, ensuring streamlining, unity, synchronization, feasibility, publicity, transparency and accessibility, promptly serving the tasks of socio-economic development, ensuring national defense, security, international integration, smooth operation of the state apparatus and political system in the conditions of organizing 2-level local government, meeting the requirements of realizing the two 100-year goals.
