At the meeting, the Government listened to reports and discussed: policy documents on the Law on Personal Income Tax (replacement); policy documents on the Law on E-commerce; policy documents on the Law on Deposit Insurance (amended); policy documents on the Law on Civil Aviation (amended); draft Law on Enforcement of Civil Judgments (amended); draft Law on amending and supplementing a number of articles of the Law on Education ; policy documents on the Law on Higher Education (amended); policy documents on the Law on Vocational Education (amended).
Removing institutions to serve development
Speaking, Prime Minister Pham Minh Chinh stated that this is the first legal thematic meeting of the Government after the Politburo issued Resolution No. 66 on innovation in law-making and enforcement to meet the requirements of national development in the new era, and the National Assembly and the Government issued resolutions to institutionalize, concretize, and implement the resolution.
Institutions are considered the resources and driving force to build and develop the country quickly and sustainably, achieving the GDP growth target of 8% this year and double digits in the coming years, and realizing the two set 100-year goals.
Therefore, ministers and heads of ministerial-level agencies need to continue to pay attention to leadership, direction, and arrangement of competent and qualified personnel, ensuring resources according to regulations, ensuring progress, and improving quality in building and perfecting laws.
The Head of Government pointed out "6 enhancements" in the guiding viewpoints on building and perfecting laws: That is, strengthening the Party's leadership, concretizing the Party's policies and guidelines; increasing the collection of opinions and absorbing opinions from relevant subjects and impacted objects.
Strengthening mechanisms and policies to create development and serve the people; increasing the reduction of administrative procedures, reducing time, costs and inconvenience for people and businesses; enhancing decentralization and delegation of power along with resource allocation, improving enforcement capacity and inspection and supervision.
Strengthen coordination with the National Assembly, the National Assembly Standing Committee, agencies in the political system and experts and scientists; strengthen adherence to practice, respect practice, start from practice, and take practice as a measure.
At the same time, assign work "6 clearly": clear people, clear work, clear time, clear responsibility, clear authority and clear results.
Therefore, in the submission of documents, draft laws for amendments and supplements need to clarify: Why are they omitted, why are they improved, why are they supplemented, why are procedures cut, why are they decentralized and delegated?
With new laws, the "four musts" must be ensured: thoroughly grasping the Party's policies and guidelines; solving practical problems and difficulties; satisfying the people's wishes; consulting with experts and scientists; and having sufficient conditions to be promulgated and put into practice.
The Prime Minister also noted that with different opinions from agencies, there must be explanations and opinions from the presenting agency; at the same time, they must be expressed briefly, concisely, and comprehensively.
Incentive mechanism for people and businesses
Commenting on specific contents in the documents and draft laws discussed at the meeting, regarding the policy documents of the Law on Personal Income Tax (replacement), the Prime Minister emphasized the requirement to collect correctly, fully, and promptly, but at the same time, it is necessary to encourage, create development, and facilitate tax payment and refund.
Regarding the policy profile of the Law on E-commerce, it sets out requirements for management while promoting development; digital management, ensuring efficiency; preventing smuggling, counterfeit goods, fake goods, poor quality goods, etc.
Regarding the policy documents of the Law on Civil Aviation (amended), it is necessary to pay attention to clear management, no overlap; promote decentralization and delegation of power; mobilize resources from people and businesses to develop infrastructure.
Regarding the draft Law on amending and supplementing a number of articles of the Law on Education; policy documents on the Law on Higher Education (amended); policy documents on the Law on Vocational Education (amended), it is necessary to note that the scale of schools and classes must be increased, branch campuses must be increased; and post-inspection must be strengthened.
Improve quality, create conditions for lifelong learning; unified professional management from the central to local levels, but human resource management must be delegated to localities.
In the field of vocational training, there are mechanisms and policies to encourage people and businesses to do better. For people and businesses that cannot do, the State must do.
