Prime Minister requests report on handling of officials and civil servants violating alcohol concentration

TPO - Prime Minister Pham Minh Chinh has just signed Directive No. 35/CT-TTg dated September 17 on handling cadres, civil servants, public employees and soldiers in the armed forces who violate regulations on driving vehicles with alcohol concentration in their blood or breath; and do not cooperate with functional forces in handling violations.

Over 7,600 party members, officials and civil servants violated the Directive. According to the Directive, in recent times, the majority of officials, party members and people have had positive changes in their awareness of law compliance, culture and behavior when participating in traffic, contributing to making traffic activities more civilized and safer. However, there are still a number of officials, civil servants, public employees, officers and soldiers in the armed forces who are not exemplary, violate the law when participating in traffic, even have substandard behavior, do not comply with the inspection and handling of the functional forces, especially in the inspection of violations of driving vehicles with alcohol concentration in blood or breath.

The Prime Minister requested to notify agencies and units to strictly handle officials and civil servants who violate alcohol concentration.

In particular, there have been a number of cases of drivers violating alcohol concentration causing traffic accidents resulting in death, fleeing the scene, resisting and not cooperating with the inspection and settlement of the authorities, causing public outrage. In 2023 and the first quarter of 2024 alone, the police force inspected, handled administrative violations and verified and sent notices to the management agencies and units for more than 7,600 party members, cadres, civil servants and public employees who violated alcohol concentration. Notice to the agency to strictly handle violations Therefore, the Prime Minister requested that when there is a notice from the competent agency about the violation of alcohol concentration by cadres, civil servants and public employees under the management scope, not cooperating with the competent force in handling the violation, the agency managing the cadres must, based on the provisions of the law on disciplinary action against cadres, civil servants and public employees and the specific regulations of the agency and unit, strictly implement the handling procedure according to the regulations. “The handling must ensure objectivity, fairness, publicity, strictness, accuracy, timeliness, proper authority, order and procedures, strictly prohibiting the covering up or concealment of shortcomings of violating cadres, civil servants and public employees, and annually (before October 15) exchanging the results of disciplinary handling with the agency sending the violation notice for synthesis and reporting to the Prime Minister,” the Directive clearly stated. In addition, the Prime Minister requested the Minister of Public Security to direct the Public Security of units and localities in the process of patrolling, inspecting and handling traffic law violations to comply with the spirit of "rule of law", "no forbidden areas, no exceptions", not accepting intervention or influence to ignore violations; strictly disciplining cadres who do not thoroughly handle or ignore violations during the process of handling administrative traffic violations. The handling process must be verified. If the violator is a cadre, civil servant or public employee who violates the alcohol concentration when driving a vehicle and does not cooperate with the authorities in handling the violation, the agency or unit managing the cadre must be notified for consideration and handling in accordance with regulations. The Minister of National Defense shall organize dissemination and discipline throughout the army on exemplary compliance with the provisions of the law when participating in traffic, especially not driving a vehicle after consuming alcohol or beer and complying with the inspection and handling of the authorities.
