Property dispute over late actor Duc Tien: Ho Chi Minh City People's Court to reopen conciliation session

The inheritance dispute between the mother and wife of the late actor Duc Tien has attracted attention. The assets include a house in Ho Chi Minh City and a plot of land in Long An.

The court has sent a notice of conciliation to the plaintiff, Ms. NBP (wife of the late actor Duc Tien) and the defendant, Ms. NNA (mother of the late actor Duc Tien). The person with related rights and obligations is MH (daughter of the late actor) with the legal representative being Ms. BP (biological mother).

Previously, on March 27, the Ho Chi Minh City People's Court opened a mediation session for the inheritance dispute of the late actor Duc Tien. However, the plaintiff's legal representative was absent, with only a lawyer present. The defendant did not come to court in person but sent a lawyer to represent him under authorization to participate in the proceedings and a lawyer to protect his legal rights and interests attended.

Due to the absence of the litigant, the court did not hold a conciliation session as scheduled. The court only recorded the opinions of the parties. Accordingly, the plaintiff maintained the original request for the lawsuit. The defendant maintained the original request for the counterclaim, and added a request for the court to determine that the land plot in Long An was the private property of the late actor Duc Tien; and to adjust the inheritance division ratio.

Duc Tien's wife and mother dispute inheritance

Recently, the dispute over inheritance rights between the wife and mother of the late actor Duc Tien has received public attention. Accordingly, Ms. NBP filed a lawsuit, requesting the court to recognize her as receiving the real estate located in Linh Dong Ward, Thu Duc City (HCMC) and a plot of land in Long An Province. The mother and daughter of the late actor each received a portion of the inheritance worth more than 666 million VND.

According to the counterclaim, Ms. NNA requested the court not to recognize the will of the late actor Duc Tien made on August 9, 2023 in the US, because this will was notarized in the US and is not in accordance with Vietnamese law.

The late actor's mother also requested the following contents: to determine the real estate in Linh Dong ward, Thu Duc city, Ho Chi Minh city as the joint property of Ms. NA and the late actor, Ms. NA will receive 50% of the house value; to determine the legacy of the late actor Duc Tien, including: 50% of the value of the real estate in Linh Dong ward (in the joint property with Ms. NA), 50% of the value of the land plot in Long An (in the joint property with Ms. BP); to divide 50% of the value of the land plot in Long An equally among the 3 first-line heirs of Mr. Tien, Ms. NA, Ms. BP, and baby MH; The management and renovation of the inheritance for Mrs. NA is 20% of the 50% value of the real estate in Linh Dong ward of the late actor, the remaining 80% is divided equally among the first-line heirs of the late actor Duc Tien, namely Mrs. NA, Mrs. BP, and baby MH. Mrs. NA is entitled to receive the real estate and pay the two co-heirs of Mr. Tien according to the above ratio.
