On the afternoon of November 8, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Property Auction.
Agreeing with the contents of the draft law, Lieutenant General Nguyen Hai Trung - Director of Hanoi City Police - said that the draft law needs to have clearer and more detailed regulations on handling investors who win a bid for a project but "run away".
Because according to the delegate, if the investor wins the bid and then does not deposit but withdraws the bid, it will cause great loss to the investment in the project, losing the trust of other genuine investors.
Expressing his views on asset auctions, delegate Hoang Van Cuong (Hanoi Delegation) also emphasized that the spirit of amending the law needs to be strict to avoid investors and people taking advantage for personal gain.
Accordingly, it is necessary to be transparent from information about asset auctions and information exchanged with bidders. In addition, the draft law must include a provision prohibiting the disclosure of information about bidders, property owners and auction organizations.
To avoid profiteering in auction activities, many opinions suggest that it is necessary to increase the deposit for property auctions.
However, delegate Hoang Van Cuong said that if the asset deposit is high, it may limit the number of people participating in the auction. Therefore, the qualifications of the auctioneer are very important, so the auction organization must prove the collateral of the auction participant.
Regarding the increasingly popular form of online auction, delegates said that the draft law should stipulate which assets should be put up for online auction to avoid profiteering.
Delegate Nguyen Thi Yen, Standing Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Ba Ria - Vung Tau, proposed considering adding regulations on handling violations against auction participants, auction winners, and related individuals and organizations.
According to the delegate, in practice, there have been cases in which auction winners have abandoned their deposits and not paid to receive the auctioned property, especially for properties of great value, such as license plates and real estate.
The delegate cited an individual who won the auction for license plate 51K-888.88 for over 32 billion VND but did not pay the auction winning price, losing the deposit he had paid in advance of 40 million VND.
Therefore, to overcome this situation, the delegate suggested that the drafting committee consider adding a regulation that when auctioning assets managed by the State, the deposit cannot be abandoned. If someone abandons the deposit, it is necessary to supplement and adjust the sanctions for this act of abandoning the deposit. There should be a measure to fine many times the deposit, to avoid auctioning successfully and then abandoning the deposit.
