On the morning of July 11, the Office of the President held a press conference to announce a number of laws passed by the National Assembly at the 9th Session, including the Law on Employment (amended).
Notably, the Law has reformed unemployment insurance policy towards becoming a tool for labor market management in the spirit of Resolution 28 of the Central Committee on reforming social insurance policy (including reforming unemployment insurance policy).
Specifically, the Law on Employment (amended) focuses on amending major and key contents such as: expanding the subjects participating in unemployment insurance to increase policy coverage and comply with the Law on Social Insurance 2024; flexible unemployment insurance contribution levels (maximum 1% of monthly salary), simplifying conditions, reducing administrative procedures for employees and employers in accessing and enjoying unemployment insurance regimes...
Deputy Minister of Home Affairs Nguyen Manh Khuong said that the revised Law on Employment inherits the provisions that have been effectively implemented from the 2013 Law on Employment, amends the provisions that are no longer suitable, and focuses on adding provisions to institutionalize the four breakthrough resolutions - the "four pillars" that bring the country into a new era.
Mr. Nguyen Manh Khuong informed that the Law institutionalizes Resolution 66 of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era.
Accordingly, the Law is designed to provide clear, substantive, concise regulations, only regulating contents within the authority of the National Assembly, closely following reality, ensuring feasibility; enhancing decentralization and delegation of power associated with clearly defining the tasks and powers of agencies, organizations and individuals in the State apparatus, improving implementation capacity.
The Law on Employment (amended) institutionalizes Resolution 57 of the Politburo on breakthroughs in science, technology, innovation and national digital transformation, adds regulations on labor registration, and serves as a basis for building a database on workers that is "correct, sufficient, clean, and alive", and is connected, updated, and shared with national databases and other specialized databases.
According to the Deputy Minister of Home Affairs, the Law also amends regulations to aim at building, managing and operating a centralized, unified, multi-layered, multi-sector labor market information system; adding regulations on developing a national job exchange...
At the same time, institutionalizing Resolution 68 of the Politburo on private economic development, this Employment Law has amended and supplemented regulations on loans for job creation in the direction of expanding the subjects, diversifying the resource mobilization mechanism to create opportunities for workers and production and business establishments to borrow capital to maintain, expand and develop production...
Deputy Minister Nguyen Manh Khuong also stated that the Law amends relevant regulations on the framework of qualifications, national vocational skills standards, assessment, and granting of national vocational skills certificates... to meet the requirements of the labor market and update with regional and world vocational skills standards and qualifications...
At the same time, the amended Law stipulates to create conditions for all workers who want to work abroad to borrow capital through the Social Policy Bank for vocational training, pay expenses..., contributing to promoting the sending of skilled workers to work in high-income, safe markets.
Another new point is the institutionalization of the Party's policy on reorganizing the political system and organizing two-level local governments. The Deputy Minister said that the Law on Employment (amended) assigns the Government to regulate the conditions for establishment, organization and operation of public employment service organizations to continue developing the system of employment service institutions in the public sector, ensuring the provision of free employment services to workers...
The Law on Employment (amended) takes effect from January 1, 2026.
