
Commune level is strongly decentralized in the land sector.
According to Clause 1, Article 5 of Decree 151/2025/ND-CP, from July 1, 2025, the Chairman of the People's Committee at the commune level is authorized to issue the first Certificate of land use rights and ownership of assets attached to land to domestic individuals, Vietnamese people residing abroad who are Vietnamese citizens and residential communities.
In addition, the People's Committee at the commune level is also decentralized to perform many other important contents in land management, including:
Decision to approve compensation, support and resettlement plan;
Approve the plan for enforcement, land recovery and funding for enforcement;
Decide on specific land prices;
Decision on selling price of resettlement housing in the commune.
Procedures for first-time issuance of Red Book are shortened
A notable reform point is that the procedure for issuing the first Red Book will be significantly shortened. Specifically, according to Appendix I of Decree 151/2025/ND-CP:
Time for first registration of land and assets attached to land is no more than 17 working days;
Time for first issuance of Land Use Rights Certificate is no more than 3 working days.
Compared to the old regulations in Decree 101/2024/ND-CP, the registration time is reduced by 3 days, helping to save time for people in the process of carrying out procedures.
People can submit their application at any unit in the same province.
A new point that clearly facilitates people is that from July 1, land and property registration files (including first-time registration and change registration) can be submitted at any application receiving unit in the same province, instead of only being submitted at the place where the land is located as before.
No more separate confirmation required for planning, disputes
According to Clause 4, Article 18 of Decree 151/2025/ND-CP, when issuing Red Books, the People's Committee at the commune level does not have to separately confirm the conformity with the planning, the absence of disputes or stable land use. This helps simplify procedures, creating conditions for people to easily access and exercise land use rights legally.
Strong decentralization of power to the commune level in land management not only contributes to streamlining the apparatus, but also helps improve the efficiency of serving people, promote administrative reform and socio -economic development at the grassroots level./.
