The new Dong Nai province will have changes in regulations on land division, land consolidation, and red book issuance.

(DN) - On June 19, Vice Chairwoman of the Provincial People's Committee Nguyen Thi Hoang listened to the Provincial Land Registration Office and localities report on regulations related to land division, land consolidation, and issuance of land use right certificates when merging Dong Nai and Binh Phuoc provinces into the new Dong Nai province.

According to the report of the Provincial Land Registration Office, to ensure consistency and unity of contents related to the development of legal documents in the field of land when Dong Nai province first came into operation, in early June, the Provincial Land Registration Office worked with the Binh Phuoc Provincial Land Management Department and the Binh Phuoc Provincial Land Registration Office. Through the work, the parties agreed on a number of contents for implementation.

Specifically, regarding the land allocation limit for individuals, it has been agreed that in wards it is 250m2 , in communes in the plains it is 300m2 and in communes in the mountainous areas it is 400m2 . The land recognition limit for individuals, depending on the ward, commune and area, ranges from 250-400m2 .

Regarding the limit for receiving the transfer of agricultural land use rights of individuals, currently in the two provinces, the regulations are similar, so there is no change.

In addition, the parties also agreed to propose conditions and minimum areas for land division and land consolidation for each type of land.

At the meeting, localities reported a number of difficulties and problems in implementing the province's regulations and the 2024 Land Law on land division, land consolidation, and land use right certificate issuance. Among them, there are problems with land consolidation conditions. The consolidated land plots must ensure the same land use purpose, land use term, and land rent payment method; in case the land plots have different land use purposes, land use terms, and land rent payment methods, they must be carried out simultaneously with the procedures for changing land use purposes, adjusting land use terms, and changing land rent payment methods to unify according to one purpose, one land use term, and one land rent payment method according to the provisions of law.

Concluding the meeting, Vice Chairwoman of the Provincial People's Committee Nguyen Thi Hoang said that in October 2024, the Provincial People's Committee issued Decision No. 63/2024/QD-UBND on the authorization to issue certificates of land use rights and ownership of assets attached to land according to the 2024 Land Law in the province. Over the implementation period, there have been thousands of cases of land plot separation, consolidation, and issuance of red books, contributing to ensuring the rights of land users.

To continue to facilitate people and ensure consistency and unity in the implementation of land law regulations in the province, provincial leaders requested to continue reviewing the regulations issued by the province and propose appropriate adjustments when Dong Nai province first comes into operation.

The Provincial Land Registration Office reviewed and improved the organization of the unit and the regional registration office branches. The policy is that the regional registration office branches are responsible for the old district-level areas, but there is a re-division to ensure smooth operation, quick and effective procedure settlement for the people.
