Khanh Hoa Provincial People's Committee reclaims land at 28E Tran Phu, Nha Trang City

Khanh Hoa Provincial People's Committee has just issued a decision to reclaim the land at 28E Tran Phu, Vinh Nguyen Ward, Nha Trang City. Accordingly, the Provincial People's Committee reclaims 20,112 square meters of land at 28E Tran Phu that was allocated and leased to Dinh Vang Nha Trang Company Limited in the decisions of the Provincial People's Committee in 2016 and 2017. The reason for reclaiming the land is to reclaim evidence according to the decision of the Provincial People's Court in Judgment No. 103, dated December 18, 2023 and of the High People's Court in Da Nang in Judgment No. 579, dated November 28, 2024.

The Provincial People's Committee assigned the Provincial Land Registration Office to correct cadastral records, update the national land database according to the provisions of law; revoke and cancel the land use right certificate, house ownership right and other assets attached to land issued to Dinh Vang Nha Trang Company Limited according to the provisions of Decree No. 101, dated July 30, 2024 of the Government .

The Provincial People's Committee assigned the Nha Trang City People's Committee to publicly post this land recovery decision and direct the Vinh Nguyen Ward People's Committee to hand over the land recovery decision to Dinh Vang Nha Trang Company Limited. In case the company does not receive the decision or is absent, a record must be made and the land recovery decision posted at the headquarters of the Vinh Nguyen Ward People's Committee and at the common living place of the ward's residential community. The Provincial People's Committee assigned the Nha Trang City People's Committee to organize the land recovery on the field. In case it is necessary to enforce land recovery, the Provincial People's Committee is requested to direct the implementation in accordance with the provisions of law.

The Provincial People's Committee requests Dinh Vang Nha Trang Company Limited to comply with the decision to reclaim land according to regulations; handle assets on the land, hand over land and documents on land use rights to the Provincial Land Fund Development Center for management according to the provisions of law. In case the company has a request for refund or civil compensation related to the reclaimed land, it can file a lawsuit for consideration and settlement.

After the revocation, the Provincial People's Committee assigned the Provincial Land Fund Development Center to receive the land and documents on land use rights from Dinh Vang Nha Trang Company Limited; transfer the certificate of land use rights, house ownership rights and other assets attached to the land granted to Dinh Vang Nha Trang Company Limited to the Provincial Land Registration Office for handling in accordance with the provisions of law.

It is known that this land was previously assigned and leased by the Provincial People's Committee to Dinh Vang Nha Trang Company Limited to implement the Nha Trang Golden Gate Project.
