Attending the meeting were: members of the Committee on Science, Technology and Environment; representatives of the Standing Committee of the Nationalities Council and Committees of the National Assembly; representatives of the leaders of the Ministry of Construction .

Vice Chairman of the Committee for Science, Technology and Environment Tran Van Khai said that the 2014 Construction Law has made positive contributions to the management of construction activities over the past decade. However, in the new context and new development requirements, the Law has revealed many limitations and problems. Comprehensive amendment of the Construction Law at this time is an urgent requirement to remove institutional bottlenecks, create new momentum for the construction industry and the economy in general; at the same time, overcome shortcomings in construction management, institutionalize the Party's guidelines and policies; and the State's policies on institutional improvement to create development.
According to the Draft Law Report, the draft Law basically inherits the policies of the current Law and amends, supplements, and perfects the regulations to ensure consistency with the provisions of the draft Law, overcome difficulties and shortcomings in practice related to: regulations on types and levels of construction works; insurance in construction activities; international cooperation in construction investment activities; prohibited acts; content of construction investment project management, management of construction investment project implementation progress; record keeping; construction; supervision, acceptance, handover, warranty, maintenance of construction works, handling of construction incidents.

The representative of the Ministry of Construction stated that the revised contents aim to innovate methods and improve the efficiency of construction investment management; define the authority and responsibility of entities participating in construction activities; and reduce and simplify administrative procedures.
Commenting on this content, the opinions basically agreed with the comprehensive amendment of the Construction Law to promptly meet the requirements set out from the practice of construction management, improve the construction investment environment and create favorable conditions for people and businesses. In addition, some opinions suggested that the drafting agency continue to review and ensure that the draft Law and the guiding documents for implementation closely follow the spirit of innovative thinking in law-making, ensuring feasibility and the authority of the National Assembly.



Some comments noted that the draft Law has many innovations in construction licensing, but also suggested that there should be a post-inspection mechanism to ensure construction activities comply with regulations, construction quality and safety for users.



Delegates also suggested continuing to identify and clarify difficulties in the practical implementation of the current Construction Law related to project classification by capital source; procedures for project establishment, appraisal and approval; regulations on project design steps; construction licensing; construction licensing authority; construction licensing subjects... to propose solutions to overcome shortcomings and remove difficulties in the draft Law.
