The Ministry of Labor, Invalids and Social Affairs has just sent a report to the Prime Minister clarifying the proposed plan to have the 2025 Lunar New Year holiday last for 9 consecutive days.
The Ministry of Labor, Invalids and Social Affairs explained that according to Clause 1, Article 112 of the Labor Code, employees are entitled to 5 days off with full pay during the Lunar New Year.
Previously, the Government Office issued an official dispatch conveying the Prime Minister's direction requesting the Minister of Labor, Invalids and Social Affairs to direct research and calculate the Lunar New Year holiday period continuously for one week, ensuring scientificity and avoiding waste.
Regarding this content, the Ministry of Labor, Invalids and Social Affairs said that Clause 1, Article 112 of the Labor Code stipulates that employees are entitled to 5 days off work and receive full pay during the Lunar New Year.
In addition, Article 1 of Decision No. 188/1999/QD-TTg stipulates that the working week for civil servants and public employees is 40 hours in 5 days, with Saturday and Sunday off.
Accordingly, the plan proposed by the Ministry of Labor, Invalids and Social Affairs in Official Dispatch No. 5152/LĐTBXH-CATLĐ for the Lunar New Year holiday, civil servants and public employees will have 5 consecutive days off in 1 week from Monday, January 27, 2025 to Friday, January 31, 2025, which is in accordance with the provisions of the Labor Code and Government regulations.
Due to the characteristics of 2025, the days before and after the Lunar New Year holiday are Saturday and Sunday, which are both weekly days off for civil servants and public employees. Therefore, civil servants and public employees will have 5 days off for the Lunar New Year holiday and 4 days off every week.
Thus, with the Tet holiday falling on all 5 working days of the week like this, civil servants and public employees will have 9 consecutive days off (including 5 days off for Lunar New Year and 4 days off every week).
Workers working overtime and night shifts during this time receive at least 300% of their normal salary.
Foreigners working in Vietnam, in addition to the general calendar, are entitled to an additional day off for their traditional New Year and one day off for their country's National Day.
Unlike previous years, in this submission, the Ministry of Labor, Invalids and Social Affairs only proposed one option for Tet holiday, which is 5 days off according to regulations, including 2 days off before Tet and 3 days off after Tet. Specifically, the official Tet holiday schedule is from Monday, January 27, 2025, which is December 28, the year of the Dragon, through December 29 and the 3 days of the 1st, 2nd, and 3rd of Tet, which is the end of Friday, January 31, 2025. However, immediately before the 5 official holidays are 2 weekend days, Saturday and Sunday, January 25-26, 2025, or December 26 and 27 of the lunar calendar. After the official holidays come the next 2 weekends, Saturday and Sunday, February 1-2, 2025. So in fact, the upcoming Lunar New Year holiday will start from Saturday, January 25, 2025 to Sunday, February 2, 2025 (ie the end of January 5, At Ty year). |
