Vietnam's interdisciplinary delegation led by Deputy Minister of Justice Nguyen Thanh Tinh at the Dialogue Session

Immediately after the Review Session of Vietnam's 4th National Report on the Implementation of the International Covenant on Civil and Political Rights (ICCPR), Deputy Minister of Justice Nguyen Thanh Tinh, Head of the Delegation, gave an interview to the press regarding this content.

Actively exchange policy and legal aspects of Vietnam

Could you please tell us the assessment of the Vietnamese delegation on the results of the Dialogue with the Human Rights Committee on the implementation of the 4th International Covenant on Civil and Political Rights of Vietnam, which recently took place at the headquarters of this agency in Geneva, Switzerland?

Deputy Minister Nguyen Thanh Tinh : Vietnam had a dialogue session with the Human Rights Committee in a frank, sincere, and open-minded spirit, and we consider this a very successful dialogue session.

The Vietnamese delegation delivered a clear message to affirm Vietnam's consistent viewpoint and policy on the motto of putting people at the center, considering it both the goal and the driving force of development. Despite many difficulties, Vietnam has always devoted the best resources, made strong efforts and commitments to promote and ensure the best implementation of human rights and civil rights, including civil and political rights under the ICCPR.

At the Dialogue, the Human Rights Committee acknowledged and appreciated Vietnam's progress in a number of areas, such as the ratification of 7 out of 9 core international human rights treaties, the building and improvement of institutions in a number of areas to prevent discrimination, and efforts to address domestic violence, gender equality and anti-corruption.

To further clarify the Committee's concerns on a number of issues, Viet Nam provided quite comprehensive information on its efforts and new developments in the process of ensuring and promoting civil and political rights since the Dialogue with the Human Rights Committee in 2019.

Members of the Interdisciplinary Working Group proactively and actively exchanged on various aspects of Vietnam's policies and laws, from institutional building and improvement, legal reform, judicial reform, to policy and law enforcement, measures to ensure human rights in practice as well as Vietnam's orientation in the coming time to continue promoting and further improving the effectiveness and efficiency in policy and law enforcement.

In the process of implementing the ICCPR Convention over the past years, could the Deputy Minister share what are the main challenges and advantages?

Deputy Minister Nguyen Thanh Tinh: The implementation of the ICCPR Convention requires huge resources and constant efforts from member states.

Vietnam also faces these difficulties in implementing the Convention, including uneven awareness of human rights among levels and regions and legal institutions that have not kept up with that requirement.

In addition, the effectiveness of law enforcement in some areas is still low, which partly affects the implementation of some civil and political rights. The complex and fluctuating international context with many security challenges also creates additional pressure on the implementation of international obligations, including the ICCPR Convention...

Regarding advantages, first of all, we have a strong political commitment, consistent viewpoints and policies of the Party and State in always identifying ensuring human rights as a consistent goal in the process of national development.

The legal system is also increasingly improved, many laws are amended and newly promulgated to internalize the provisions of the ICCPR Convention, contributing to improving the effectiveness of protecting civil and political rights.

Vietnam is increasingly recognized and appreciated by the international community for its efforts to implement international commitments on human rights, while maintaining constructive dialogue with the United Nations human rights mechanisms.

Continue to strengthen effective implementation of the ICCPR Convention

From the results of this 4th Dialogue Session and the advantages and challenges as the Deputy Minister just shared, could you please tell us what orientations Vietnam will have to continue to improve the effectiveness of the implementation of the ICCPR Convention in the coming time, especially the implementation of the recommendations of the Human Rights Committee made after this 4th Review Session?

Deputy Minister Nguyen Thanh Tinh: Resolution No. 27-NQ/TW dated November 9, 2022 of the 6th Conference of the 13th Party Central Committee on continuing to build and perfect the socialist rule-of-law State of Vietnam in the new period (Resolution No. 27-NQ/TW) requires continuing to institutionalize and promptly and fully concretize the Party's viewpoints and policies and the provisions of the Constitution on human rights, basic rights and obligations of citizens; internalize international treaties on human rights that Vietnam has participated in; and well implement the principle that citizens are allowed to do everything that is not prohibited by law.

Most recently, Resolution 66-NQ/TW dated April 30, 2025 of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era sets out the task of building and perfecting laws and organizing law enforcement to ensure human rights.

From the above-mentioned Party's guiding viewpoints and orientations, in order to improve the effectiveness of the implementation of the ICCPR Convention in the coming time, after this Dialogue Session, we will develop and submit to the Prime Minister for promulgation a National Action Plan with the participation of relevant ministries, branches and entities to continue to strengthen the effective implementation of the ICCPR Convention and the recommendations of the United Nations Human Rights Committee stated at this Dialogue Session. I believe that this Plan should focus on performing well the following tasks:

Firstly, continue to strengthen the dissemination and raise awareness of cadres, civil servants and public employees, especially in law-making and law enforcement agencies, about the Party's viewpoints, policies and orientations on human rights in the work of building and perfecting the legal system, organizing law enforcement, and judicial reform as set forth at the 13th National Party Congress, Resolution No. 27-NQ/TW, Resolution No. 66-NQ/TW... foster and improve the professional expertise and professionalism of cadres working in law-making and law enforcement in the management field directly related to the people to disseminate the Party's viewpoints and policies that consider people as the center and subject of the cause of innovation, building and defending the Fatherland; all policies and strategies must truly originate from the lives, aspirations, rights and legitimate interests of the people, taking the happiness and prosperity of the people as the goal to strive for.

Second, continue to review and institutionalize the Party's guidelines and policies on human rights and internalize international treaties on human rights to which Vietnam is a member, ensuring a democratic, fair, humane, complete, timely, synchronous, unified, public, transparent, stable, feasible, accessible legal system that takes the legitimate and legal rights and interests of people as the center to ensure human rights.

We identify Resolution No. 66-NQ/TW as the guideline for innovating the work of law making and enforcement in the coming time. In the coming time, the Ministry of Justice and relevant ministries and branches need to focus on fully implementing the tasks assigned in Resolution No. 140/NQ-CP dated May 17, 2025 of the Government promulgating the Government's Action Program to implement Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo on innovating the work of law making and enforcement to meet the requirements of national development in the new era, in which the key task in 2025 is to implement the Resolution of the National Assembly on the mechanism for handling difficulties and obstacles due to legal regulations - a legal corridor to remove bottlenecks, creating a more open institutional environment for the enforcement of human rights.

At the same time, effectively implement the two-tier local government model associated with administrative procedure reform and providing online public services so that people can actually enjoy the benefits of the revolution in streamlining the state apparatus that we are implementing.

Central ministries and branches also need to promptly guide the handling and resolution of shortcomings (if any) when localities operate under the new organizational model; strengthen post-inspection to enhance the responsibility of performing public duties at the grassroots level, ensuring that the law is effectively enforced, including ensuring human rights and civil rights.

Third, well performing the tasks set out in Resolution No. 66-NQ/TW on creating breakthroughs in law enforcement, ensuring that laws are implemented fairly, strictly, consistently, promptly, effectively and efficiently; closely linking legislative work and law enforcement, ensuring that laws come into life, this is also the content raised by the Human Rights Committee at this Dialogue Session.

Accordingly, in the coming time, agencies need to focus on strengthening and improving the effectiveness of law enforcement, especially in areas directly related to human rights, ensuring that laws are applied consistently, systematically, strictly, and in accordance with the requirements of national development; perfecting and effectively implementing the mechanism for receiving and promptly and effectively handling suggestions and feedback from people and businesses; improving the effectiveness of inspection and examination activities in the performance of public duties and state management of areas directly related to human rights.

In addition, it is necessary to pay attention to innovating the dissemination and education of laws on human rights in a people-centered direction, prioritizing resources for dissemination and education of laws for vulnerable groups, people in mountainous areas, and ethnic minorities; strengthening policy communication on legal documents on human rights, especially in the policy-making stage, aiming to be suitable for specific groups.
