The Government Office issued Notice No. 275/TB-VPCP on the conclusion of Deputy Prime Minister Tran Luu Quang at the Preliminary Conference of the National Steering Committee on combating illegal, unreported and unregulated fishing (IUU).

In the announcement, the Deputy Prime Minister highly appreciated the efforts of ministries, sectors and localities in the past time and the results achieved. However, in general, up to now, in some localities, there are still many shortcomings and limitations that are slow to be overcome, not ensuring progress according to the direction of the Prime Minister and the Head of the National Steering Committee on IUU.

Specifically: the situation of fishing vessels and fishermen illegally exploiting in foreign waters continues to occur, with complex and sophisticated developments; there are many cases of intentionally removing and transporting fishing vessel monitoring equipment (VMS) for illegal exploitation; "03 no" fishing vessels have not been managed and controlled; the overcoming of existing shortcomings and limitations pointed out by the EC in the 4th inspection has not had many positive changes...

Carefully prepare the working content with the 5th EC Inspection Delegation

The 5th inspection by the EC (scheduled for October 2024) is the decisive time for Vietnam to remove the "Yellow Card" warning in 2024; therefore, relevant sectors and levels from central to local levels must identify this as an important task, unify actions with the highest determination to remove the "Yellow Card" warning. Therefore, the Deputy Prime Minister suggested focusing on implementing urgent and key tasks and solutions from now until September 2024, ensuring that there are specific data and results to work with the EC Inspection Delegation.

The Deputy Prime Minister requested relevant departments, ministries, branches and localities to focus on leading and directing functional agencies to seriously implement Directive No. 32-CT/TW of the Secretariat, Resolution No. 52/NQ-CP of the Government and the instructions of the Prime Minister and the Head of the National Steering Committee on IUU and other relevant documents, ensuring the progress and effectiveness of work; carefully prepare the content, program and working plan with the 5th EC Inspection Delegation to ensure the best results.

Allocate sufficient resources (human resources, funding, equipment, means) to carry out the task of combating IUU fishing and removing the "Yellow Card" warning. Periodically, before the 30th of each month, report the situation and results of combating IUU fishing to the Ministry of Agriculture and Rural Development (Standing Body of the National Steering Committee on IUU) for synthesis and reporting to the Secretariat, the Government, the Prime Minister and the Head of the National Steering Committee on IUU.

The Deputy Prime Minister noted that it is necessary to attach responsibility to the heads of Party committees, authorities at all levels and functional forces, resolutely handle the responsibilities of organizations and individuals who do not fulfill their assigned duties and tasks, report the results of the handling to competent authorities; promptly encourage, reward and motivate typical examples in combating IUU fishing.

To effectively and efficiently implement, relevant ministries, branches, People's Committees of coastal provinces and centrally run cities launch a peak period of law enforcement, handling IUU fishing violations from central to local levels to create a strong change in the fight against IUU fishing. Urgently consolidate records to strictly handle violations according to regulations as soon as the Resolution takes effect.

The Ministry of Agriculture and Rural Development shall preside over and coordinate with ministries, sectors, and localities in various forms to carry out information and communication, widely disseminate regulations on criminal handling related to IUU fishing violations in Resolution No. 04/NQ-HDTP of the Council of Judges of the Supreme People's Court to create changes in awareness of law compliance, deterrence, and education.

Prosecution of brokers who illegally send ships for exploitation

The Ministry of Public Security has issued a document directing local police forces to coordinate in investigating, prosecuting, prosecuting, and trying cases of law violations related to brokerage, collusion to bring fishing vessels and fishermen to illegally exploit in foreign waters; acts related to removing, sending, and transporting voyage monitoring equipment; violations specified in Resolution No. 04/NQ-HDTP of the Council of Judges of the Supreme People's Court; handling a number of cases for deterrence, education, completion, and reporting to the Prime Minister on implementation results in August 2024.

The Deputy Prime Minister also requested the Ministry of Agriculture and Rural Development to continue to perform well its role as the Standing Agency of the National Steering Committee on IUU; regularly monitor, urge, guide and report on the results of the implementation of the task of combating IUU fishing.

The Ministry of Agriculture and Rural Development regularly inspects and supervises localities and relevant local authorities in implementing regulations against IUU fishing, including at sea; promptly advises and proposes competent authorities to handle responsibilities for organizations and individuals who fail to fulfill their assigned duties and tasks according to the direction of the Secretariat, the Government, and the Prime Minister.

The Ministry of National Defense continues to increase forces and means to carry out peak patrols, inspections and controls in sea areas bordering other countries; direct the Border Guard Command, border posts and stations along the coast to increase the frequency of patrols, inspections and controls of fishing vessels entering and leaving ports, at river mouths, inlets, seaports and islands; especially in the southwestern provinces.

Strictly discipline border guards who allow fishing vessels violating IUU fishing to enter or exit ports to participate in fishing activities, and affiliated functional forces who assist and condone IUU fishing.

At the same time, preside over and coordinate with localities with fishing vessels violating illegal exploitation in foreign waters and the Ministries of Agriculture and Rural Development, Public Security, and Foreign Affairs to thoroughly punish violations detected from the beginning of 2023 to present, complete and report the results to the Prime Minister in September 2024.

The Ministry of Public Security directed to strengthen the police force, the police of 28 coastal localities to carry out the peak task of coordinating with local authorities and border guards to firmly grasp the area, prevent and handle right from the shore fishing vessels and fishermen intending to violate illegal IUU fishing in the southwestern provinces, especially in the key provinces of Kien Giang and Ca Mau.

The Ministry of Justice urgently advises on supplementing the authority to sanction administrative violations in the field of fisheries for the Heads of Sub-Departments under the Department of Agriculture and Rural Development with the function of state management of fisheries or performing functions and tasks of fisheries control according to the provisions of law; complete and report to the Prime Minister on the implementation results in August 2024.

Tighten management of local fishing activities

The Chairman of the People's Committee of coastal provinces and centrally-run cities shall focus on leadership, direction, and allocation of sufficient resources, and clearly assign responsibilities to local agencies and functional forces to thoroughly resolve existing problems and limitations, ensuring that there are specific data and results to prove at the 5th inspection by the EC.

Urgently direct the completion of granting fishing licenses, registration, inspection, marking of fishing vessels, installation of VMS equipment, issuance of Food Safety Certificates for fishing vessels; fully update fishing vessel data into the national fisheries database (VNFishbase), complete and report to the Prime Minister on implementation results in July 2024.

The Chairman of the People's Committee of coastal provinces and centrally run cities shall direct functional forces to monitor, manage and control 100% of local fishing fleets and fishing vessels of other localities operating in the locality; thoroughly handle the number of "3 no" fishing vessels in the locality according to regulations.

At the same time, direct functional forces to increase the frequency of managing fishing vessel activities at sea and at ports, strictly implement legal regulations to prevent fishing vessels violating IUU fishing from entering or leaving ports, and fishing vessels that do not meet the prescribed conditions from participating in fishing activities.

Direct functional forces to focus on and resolutely enforce the law, investigate, verify, and strictly handle IUU fishing acts, and organizations and individuals involved in condoning and assisting IUU fishing acts; including thoroughly handling 100% of serious violations of disconnecting VMS, dismantling and transporting VMS equipment, and illegal fishing violations in foreign waters from the beginning of 2023 to present, completing and reporting to the Prime Minister on the implementation results in August 2024.

Continue to review and strictly implement the work of confirming, certifying, and tracing the origin of exploited aquatic products; do not allow violations of "document legalization" for shipments exported to the European market.

Proactively issue mechanisms and policies within authority to tighten management of local fishing activities, combat IUU fishing, support livelihood stabilization, and career conversion for fishermen participating in fishing activities.

The Vietnam Association of Seafood Exporters and Producers (VASEP), the Vietnam Tuna Association, and seafood exporting enterprises must be responsible for strictly complying with IUU regulations, purchasing, processing, and exporting exploited seafood to ensure traceability.

The Vietnam Fisheries Association actively encourages members to set an example and implement regulations against IUU fishing; coordinate with agencies and functional forces to promptly report and denounce IUU fishing violations.
