Wall collapse kills 5 people in An Nhon: Prosecution, temporary detention of 1 project manager, 1 construction company director
(BĐ) - On May 9, the Provincial People's Procuracy announced that the unit had approved the decisions to prosecute the accused and the order to temporarily detain the accused Dao Ngoc Khoa (born in 1981, Hung Yen ), Deputy Director of Gia Phu Engineering and Construction Joint Stock Company (Gia Phu Company) - Project Manager and Nguyen Thanh Duong (born in 1989, in Quy Nhon City), Director of Tan Duong Construction and Trading Company (Tan Duong Company) for the crime of "Violating construction regulations causing serious consequences" prescribed in Clause 3, Article 298 of the Penal Code.
These are the 2 defendants involved in the case that occurred at the K2 Frame construction site (Nhon Hoa Industrial Park, An Nhon Town) by the construction unit, Tan Duong Company, with 12 workers directly involved in the construction. At about 4:15 p.m. on September 15, 2022, while the cement was being plastered, it rained and was windy, the wall shook and collapsed, killing 5 people (of which 3 died on the spot), 6 people were injured and 1 person managed to escape.
On September 16, 2022, the Investigation Police Agency (Provincial Police) initiated a case on the act of "Violating construction regulations causing serious consequences" according to the provisions of Article 298 of the Penal Code.

The investigation determined that the cause of the incident was: The contractor applied unreasonable construction methods that did not ensure absolute stability and safety; the entity responsible for managing construction safety did not fully implement appropriate and necessary technical measures to ensure stability during the construction process. Therefore, when subjected to adverse impacts of wind loads, Frame K2 had excessive peak displacement, exceeding the allowable limit, causing overall instability; the two defendants Duong and Khoa themselves also admitted that the construction of the Frame K2 wall (which collapsed) was 15.3m high and 38m long, but there were no measures to support or tie it to any fixed point, and it was unsafe to let it stand alone, but they still let the workers carry out the construction without consulting the investor and related units to find a solution or stop the construction.
On May 4, 2023, the Investigation Police Agency (Provincial Police) issued a Decision to prosecute the accused and an Arrest Warrant to detain Khoa and Duong for the crime of "Violating construction regulations causing serious consequences"; at the same time, the case file was transferred to the Procuracy for approval.
It is known that Savvy Seafood Vietnam Company Limited (Savvy Seafood Company) was licensed by the Provincial Economic Zone Management Board to build a seafood processing factory in Nhon Hoa Industrial Park, An Nhon Town. After that, Savvy Seafood Company signed a contract to outsource all 14 construction items to Vinh Bao Construction and Joint Stock Company (Vinh Bao Company), Vinh Bao Company continued to sign a contract to outsource all the above construction items to Gia Phu Company. In early April 2022, Khoa, representing Gia Phu Company, agreed with Duong to assign Duong to construct the factory's surrounding walls and the K2 Frame wall separating the factory from the cold storage (until June 2022, Duong established Tan Duong Company and signed a contract with Gia Phu Company).
The case is currently being investigated and clarified by the Investigation Police Agency (Provincial Police).
