The case of "temporary road encroaching on the river": Construction without sufficient conditions

Accordingly, Khanh Hoa Provincial Department of Construction has worked with the investor, Nam Nha Trang Ward People's Committee and related agencies and units to verify the content.

Specifically, Ha Long Sun Company Limited (hereinafter referred to as the company) was assigned as the investor of the Nha Trang Mixed Urban Area project; the above-mentioned land filling and leveling work was carried out by the company to construct a temporary bridge to serve the construction of the main works of the project.

The location of the traffic connection land has been agreed upon by the Provincial People's Committee in Document No. 26/UBND-XDND dated July 3, 2025; The Investor has worked with the Provincial Management Board of Investment and Construction of Agricultural and Traffic Works (with working minutes dated July 7, 2025).

However, at the time of working with the Department of Construction, the investor had not yet sent the construction design documents that had been assessed for safety conditions to the local construction authority for monitoring and inspection according to regulations. The investor had not yet been handed over the site.

The Department of Construction determined that the project investor had constructed a temporary bridge to serve the main project without fully meeting the conditions prescribed in Clause 3, Article 131 of the 2014 Construction Law (amended and supplemented in Clause 49, Article 1 of Law No. 62/2020/QH14).

In this situation, the Department of Construction has requested a temporary suspension of construction and requested the investor to promptly complete the construction design documents that have been reviewed for safety conditions and send them to the Department for monitoring, inspection and handling according to regulations. After receiving the documents provided by the investor, the Department of Construction will coordinate with relevant agencies and units to guide the investor to comply with regulations.

The Department of Construction also requested the People's Committee of Nam Nha Trang Ward to strengthen the management of construction order in the area; proactively grasp information and promptly coordinate with relevant agencies and units to handle arising issues.

Previously, as SGGP Newspaper reported, in the Quan Truong River area (through Nam Nha Trang ward), a section of the road railing was dismantled; soil and rocks were dumped and leveled towards the riverbed, forming a temporary bridge/road.

Some locals said that this temporary road has been around for many days, however, there is no public information about the project or the investor in the area. By the afternoon of July 14, a leader of the Khanh Hoa Province Department of Construction said that he had ordered a temporary halt to the leveling of the riverbed area mentioned above.
