According to the 2014 Construction Law, regulations on construction permits include term-based construction permits and phased construction permits.

Accordingly, a construction permit with a term is a permit granted for a construction or individual house to be used within a certain period of time according to the construction planning implementation plan.

A phased construction permit is a construction permit for each part of a construction or each construction of a project when the construction design of the construction or project has not been completed.

The application for a housing construction permit includes the following documents: Application for a construction permit, documents proving land use rights according to land law regulations, 2 sets of construction design drawings with a certificate of design approval on fire prevention and fighting with approved drawings in case the law on fire prevention and fighting requires it.

Construction design review report in case required by construction law includes: Drawing of construction site plan on the land lot with attached location diagram of the construction; Drawing of floor plans, main elevations and sections of the construction; Drawing of foundation plan and foundation section with attached connection diagram of technical infrastructure system outside the construction including water supply, drainage, and electricity supply.

In case there is an adjacent construction, there must be a commitment to ensure safety for that adjacent construction.

Depending on the specific conditions of the locality, the People's Committee of the province or centrally-run city shall publish sample design drawings for households and individuals to refer to when making their own construction designs.

From the date of receiving a complete and valid dossier, the competent authority to grant a construction permit must review the dossier to grant a permit within 15 days for individual houses in urban areas; 10 working days for houses in rural areas.

In case the license issuance deadline has come but further consideration is needed, the construction licensing authority must notify the investor in writing of the reason and at the same time report to the direct management authority for consideration and direction of implementation, but no later than 10 days from the expiration date.

In addition to the cases where a building permit is required, there are also cases where a building permit is exempted. Specifically: One is a single-family house with a scale of less than 7 floors belonging to an urban area construction investment project, a housing construction investment project with a detailed 1/500 plan approved by a competent state agency (in this case, the commencement date must be notified).

Second, individual houses in rural areas with a scale of less than 7 floors and located in areas without functional area construction planning, urban planning or detailed planning for rural residential areas approved by competent state agencies.

Third, individual houses in mountainous and island areas in areas without urban planning or functional area construction planning.
