Minister of Construction talks about the absurdity of applying for a construction permit

Minister of Construction Tran Hong Minh said that from detailed planning, pre-feasibility study project establishment to technical design, there are regulations. When people and businesses want to rebuild, they have to apply for a permit "which is completely unreasonable".

At the National Assembly 's discussion session on November 14 on the draft Law on Construction (amended), Minister of Construction Tran Hong Minh explained a number of issues of concern to delegates.

Regarding construction licensing, Minister Tran Hong Minh said this is an issue of great concern to delegates.

According to the Minister, state agencies, businesses, and people all need licenses, but it is unreasonable when detailed planning, pre-feasibility study project preparation, feasibility study, technical design, and construction drawings are all regulated. Before construction, people and businesses must apply for a license, "which is extremely unreasonable."

Therefore, the Minister of Construction said the amended law will only require appraisal of one of these steps. For example, if the project is appraised, a license will not be required.

"For constructions that are not included in the planning and are larger than 7 floors, a construction permit is still required," Mr. Minh said, adding that he has instructed localities to implement this.

For special projects and works, the Minister said that licensing procedures for people must be simplified.

Regarding the quality of the project, the Minister said that up to now, it has been carried out in full steps, accepting each work item, accepting phase transition, completing phases, accepting putting into use, when the warranty period expires and accepting equipment...

"These regulations are clearly stated in the acceptance procedures and decrees as well as guiding circulars of the construction industry. Over the past years, the implementation has been carried out very strictly," the Minister informed.

Referring to a number of incidents related to construction quality such as the Song Lo bridge case, which is being investigated by authorities to clarify the cause, the Minister affirmed that in terms of law, the current legal regulations are complete and the implementation is carried out by the investor, consultant, and supervisor.

Regarding construction materials, the Minister said that the construction industry has standards and regulations for using materials that meet the conditions for green, clean, and smart urban areas. The Minister clearly stated that when implementing projects, it is necessary to study and apply them to ensure the environment and health of the people.

At the previous discussion session, delegate Ta Van Ha ( Da Nang ) hoped that this amendment to the law would help overcome long-standing problems, especially the "disease" of overlapping, which has lasted for many years. Mr. Ha mentioned the situation of project investment, especially key projects, which had to be adjusted many times, prolonging the time, leading to capital increase and slow progress.

Regarding construction permits, delegate Ta Van Ha agreed with many opinions that the construction permit procedure should be boldly abolished for the people in many cases. Although there are still concerns, according to him, construction permits are not the only tool for state management.

Citing the hundreds of thousands of constructions that Hanoi has every year, the delegate said that the number of violations of construction order only accounts for a very small percentage. Mr. Ha raised the question of whether licensing can really solve the violations.

“We see very clearly that even with licensing, there are still many violations. So the problem lies elsewhere, not in the licensing procedure,” he acknowledged.

Concerned that abolishing licensing will make urban management difficult, Mr. Ha said the main problem is the inspection and handling of violations. "If we do it seriously and handle it seriously, everything will be in order," he emphasized.
