
The amended Construction Law comprises 8 chapters with 95 articles and will take effect from July 1, 2026, although some provisions will take effect earlier, from January 1, 2026.
Notably, the law expands the scope of projects exempt from construction permits and construction order management, including individual houses in rural areas; and projects whose feasibility studies have been assessed and approved by specialized construction agencies. Construction projects of level IV, individual houses with less than 7 floors and a total floor area of less than 500m² (not located in special planning areas) are also exempt from construction permits. However, for projects exempt from construction permits, investors still need to submit a notice of commencement of construction to the local state management agency for construction. This provision will take effect early, from January 1, 2026.
In addition, the process of issuing construction permits will be simplified, implemented through online public services, and utilize information technology and digital transformation; reducing time and costs by at least 30% compared to the current system.

To prevent the exploitation of legal loopholes, the law also clearly stipulates a method of conducting comprehensive probabilistic inspections to ensure construction safety and avoid the risk of discovering violations only after the project is completed.
Construction order management is stipulated to be carried out from the time of receiving the commencement notice, through the commencement of construction, until the project is inspected, handed over, and put into operation and use, in order to detect, prevent, and promptly handle violations when they occur.
For high-risk construction projects, the investor must install warning signs and construction monitoring equipment at the construction site from the very beginning of the construction preparation phase.
