Accordingly, the revised and supplemented draft law stipulates many contents related to the conversion of the method of managing cadres and civil servants according to job positions. The draft law clearly stipulates that the evaluation, arrangement and use of cadres and civil servants must be based on the requirements of the job position and the capacity, results and effectiveness of the cadres and civil servants in performing their tasks.
At the same time, the regulation on promotion exams will be eliminated and replaced by a mechanism of assigning each job position to the corresponding civil servant rank, linked to capacity and performance results. Thereby, reducing administrative procedures and creating real motivation for cadres and civil servants.
Along with that is the innovation in civil servant recruitment in the direction that the selected person must immediately meet the requirements of the job position, after being selected, they will be appointed, have their salary ranked in the civil servant rank corresponding to the selected job position and do not have to undergo probationary period.
The draft law also stipulates flexible recruitment methods. In addition to traditional examinations and selection, it also adds the form of receiving talented and experienced people from the non-public sector, public service units, state-owned enterprises, etc., or signing fixed-term contracts with experts, scientists , and people who meet the standards and conditions to perform certain tasks of professional and technical civil servant positions.
In addition, the draft law amends and supplements regulations to improve the effectiveness of evaluating, using and screening cadres and civil servants, which stipulates that the evaluation of cadres and civil servants must be based on the results of performing tasks and specific work products according to the requirements of the job position, instead of being based on general, formal or emotional criteria.
Supplementing mechanisms to eliminate the mindset of "lifetime tenure" and improve administrative discipline and order; clearly defining the responsibilities of leaders in managing, evaluating and using civil servants according to their capacity and job position...
Reporting on the review of the draft Law on Cadres and Civil Servants (amended), Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung said that the Committee agreed to amend the regulations to connect cadres and civil servants at the commune level with the provincial level, unifying the civil service regime from the central to the commune level.
He said that the current interconnection is mature enough and is an urgent requirement to implement the policy of streamlining the organizational apparatus and implementing the 2-level local government model.
The Committee also agreed to continue to stipulate the principle of managing cadres and civil servants as "a combination of title standards, job positions and staffing quotas", and at the same time perfect the regulations on job positions and civil servant ranks as a basis for continuing to innovate the work of managing cadres and civil servants.
Regarding the proposal to add a framework of criteria for determining "talented people" to avoid inconsistent application among ministries, branches and localities, the Committee will assign the Government to prescribe principles, procedures, and approval authority for job positions to ensure flexibility and meet state management requirements in each period.
The bill is also proposed to add many contents such as: the basis for determining job position is "actual workload"; carefully assess the impact of adding regulations on signing fixed-term contracts for experts, scientists, people who meet professional and technical conditions to perform some tasks of professional and technical civil servant positions...
