Accordingly, in order to promptly handle issues arising related to legal documents issued by the People's Committee of Bac Lieu province (before the merger) and the People's Committee of Ca Mau province (before the merger) on management authority, regimes and policies for cadres, civil servants and public employees; in order to ensure continuity in management work, not to interrupt the settlement of legitimate rights and interests of cadres, civil servants and public employees after the merger, the Provincial People's Committee agrees on the following policy:
1. Unification in the application of legal documents .
For legal documents related to management authority and regimes and policies for cadres, civil servants and public employees, it is recommended to follow the direction of the Chairman of the Provincial People's Committee in Official Dispatch No. 0593/UBND-NC dated July 14, 2025 on the implementation of legal documents according to spatial effectiveness. In addition, the implementation process should note the following contents:
- Regarding the authority to appoint, re-appoint, and extend the term of office to retirement age for leaders at the department level and equivalent or lower at provincial departments, branches and sectors: Apply according to the regulations on appointment authority in Decision No. 37/2018/QD-UBND dated December 12, 2018 of the People's Committee of Ca Mau province, specifically: Heads of provincial departments, branches and sectors decide to appoint, re-appoint, and extend the term of office to retirement age for Department Heads, Deputy Department Heads and equivalents under their management; Heads of units under provincial departments, branches and sectors decide to appoint, re-appoint, extend the term of office to retirement age, resign, and dismiss Department Heads, Deputy Department Heads and equivalents of units under provincial departments, branches and sectors; except where otherwise provided by law.
- Regarding salary regime and salary allowances for civil servants of provincial departments, branches and sectors: Apply Articles 10, 11, 12, 13, and 14 of Decision No. 48/2021/QD-UBND dated December 20, 2021 of the People's Committee of Ca Mau province promulgating Regulations on decentralization of management of civil servants under the management authority of the People's Committee of Ca Mau province.
- Regarding the authority to recruit, use and manage civil servants of provincial departments, branches and sectors: Apply Decision No. 67/2024/QD-UBND dated December 23, 2024 of the Provincial People's Committee promulgating the Regulation on decentralization of authority to recruit, use and manage civil servants under the management of the People's Committee of Ca Mau province, except in cases where specialized laws provide otherwise.
- Other contents are implemented according to relevant legal provisions, contents assigned, authorized or directed by the Provincial People's Committee or competent authority.
2. On the appointment of department-level leaders and equivalent at merged agencies and units .
In order to ensure the arrangement of the number of deputies according to regulations, the Provincial People's Committee requests the following agencies and units to merge:
- Regularly review and evaluate the overall number and arrangement of deputy heads of departments and equivalent; proactively arrange and transfer appropriately between departments, divisions and units to ensure balance in quantity, consistent with job positions, standards, conditions, capacity, strengths and requirements of assigned tasks;
- Limit the appointment of new deputies in places with an excess number of deputies while the organizational structure has not been completed. In cases where it is really necessary to appoint new deputies because it is not possible to arrange or assign from the existing team of deputies, the agency or unit must report and ask for the opinion of the Chairman of the Provincial People's Committee before implementing.
