Strictly handle violations of not implementing electronic invoices

The People's Committee of Ha Tinh province directed functional agencies and local authorities to coordinate in detecting and strictly handling violations of not implementing electronic invoices.

Vice Chairman of the Provincial People's Committee Tran Bao Ha has just signed a document directing the strengthening of management and use of electronic invoices for petroleum business and retail activities in Ha Tinh.

Strictly handle violations of not implementing electronic invoices

Ha Tinh Petroleum Company has smoothly operated the process of issuing electronic invoices for each sale at 100% of stores.

Accordingly, the Provincial People's Committee requested the Provincial Tax Department to resolutely direct tax branches to continue to promote and diversify measures and solutions to disseminate to taxpayers, stores, and petroleum businesses the regulations on issuing electronic invoices for each sale in Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government regulating invoices and documents.

At the same time, preside over and coordinate with the Department of Industry and Trade, Department of Science and Technology, Department of Information and Communications, Department of Market Management of the province, Provincial Police and People's Committees of districts, cities and towns to immediately deploy synchronous and effective solutions, resolutely requesting petroleum business units to issue electronic invoices for each sale at petroleum retail stores; grasp the current situation, level and ability to implement electronic invoices for each sale, the ability to connect data with tax authorities of petroleum retail stores according to regulations (especially small petroleum stores in remote areas); complete in the first quarter of 2024.

Preside over and coordinate with the Provincial Police, the Department of Information and Communications and relevant agencies to build and complete the information technology system for electronic invoices, ensuring that the reception and connection of electronic invoice information by tax authorities is smooth and convenient, contributing to improving the efficiency of tax management; to be completed in the first quarter of 2024.

Preside over and coordinate with the Provincial Police and relevant agencies, units and localities to strengthen inspection and examination of the issuance of electronic invoices for each sale at petrol stations, ensuring compliance with regulations; strictly handle cases of non-compliance or intentional non-compliance according to the law.

The Provincial Police shall preside over and coordinate with the Provincial Tax Department and relevant agencies in connecting population data with the tax sector and localities to coordinate in detecting and strictly handling violations of not implementing electronic invoices. Coordinate with the Provincial Tax Department to strengthen inspection and examination of the issuance of electronic invoices for each sale at petrol stations and handle violations in accordance with the provisions of law.

The Department of Industry and Trade shall preside over and coordinate with the Provincial Market Management Department, the Provincial Police and relevant agencies to closely monitor and inspect the compliance with legal regulations on petroleum trading by petroleum trading units in the area, especially regulations on the implementation of electronic invoices and the provision of electronic invoice data in accordance with the Law on Tax Administration, guiding documents of the Ministry of Finance and tax authorities; strictly handle violations of regulations on petroleum trading conditions; coordinate with the Provincial Tax Department to inspect, monitor and handle violations of the law on electronic invoices for each sale of petroleum trading units in accordance with the law.

Ha Tinh Market Management Department strengthens inspection, control, and monitoring of the operations of petroleum trading establishments in the area to promptly detect and strictly handle violations of petroleum trading conditions; coordinates with tax authorities to inspect and supervise the compliance with regulations on electronic invoices for each sale of petroleum trading units in accordance with the provisions of law.

The Department of Information and Communications directs press, radio and television agencies in the province to coordinate with the Provincial Tax Department to continue to promote and diversify propaganda measures and solutions to help consumers, businesses and petrol retailers clearly understand the benefits and responsibilities, and effectiveness of implementing regulations on issuing electronic invoices for each sale in Decree No. 123/2020/ND-CP dated October 19, 2020 of the Government, and penalties for violations of regulations on invoicing when selling goods in Decree No. 125/2020/ND-CP dated October 19, 2020 of the Government.

Relevant departments, branches and sectors closely coordinate with the Provincial Tax Department in connecting, sharing information, data, inspecting, checking and supervising the issuance and use of electronic invoices, especially in the petroleum sector... to improve the efficiency and effectiveness of tax management, prevent tax fraud, tax evasion and tax loss.

People's Committees of districts, cities and towns direct specialized departments, offices and local police forces to closely coordinate with tax authorities to grasp the current situation of electronic invoice implementation for each sale, the level and ability to meet the implementation of electronic invoices for each sale, connect with tax authorities of local retail gasoline stores to advise and propose drastic solutions and measures to promote and supervise local retail gasoline units to issue electronic invoices after each sale according to regulations. Strengthen direction for specialized departments and offices to closely coordinate with tax authorities to promote management, inspection and supervision, detect and strictly handle violations, failure to implement or intentionally not to issue electronic invoices for each sale for gasoline retail activities in the area and connect electronically with tax authorities.
