85 bags of rice "turned to mud" because they were prevented from being transported (!?)

85 bags of rice worth tens of millions of dong belonging to a household in Quang Dien commune (Krong Ana district) were completely damaged because others prevented them from being transported.

It is worth mentioning that the incident happened over many hours with urgent calls for help from the people, but the local authorities did not have timely and flexible intervention measures to protect the legal property of citizens.

Mr. Nguyen Viet Hung (born in 1970, residing in Hamlet 3, Quang Dien Commune) stated that on the morning of May 28, 2025, he and his wife brought the harvester down to harvest 7 sao of rice belonging to their family. This field has been cultivated stably by Mr. Hung and his wife for many years, with full land use rights certificates (the North borders the Krong Ana River, the South borders the field that Mr. Hung and Mrs. Nguyen Thi Thu Huong's family are disputing and has been accepted by the People's Court of Krong Ana District). However, while the harvester was operating, Mrs. Huong and her husband (who live about 300 m away) suddenly came out, cursed and prevented them from continuing the harvest.

Mr. Hung immediately went to the People's Committee of Quang Dien commune to ask for help from the police. When the commune police arrived, the situation calmed down. At 11 am, when Mr. Hung finished harvesting the rice, packed it into 85 bags and was about to transport it home, Mrs. Huong's family continued to block him, resolutely not allowing him to go up to the riverbank. The reason Mrs. Huong said was that the riverbank was her family's land, so she did not allow Mr. Hung and his wife to go across. However, according to Mr. Hung, this was a common path for households growing rice in the area for many years, not the land of any individual.

Mr. Nguyen Viet Hung and his wife reported that others obstructed their transportation, causing damage to 85 bags of rice.

Once again, Mr. Hung called for help from the commune police. Although the authorities were present and tried to persuade them, Mrs. Huong and her husband still resolutely refused to move the rice to the shore. And from 11am to 5pm, all the rice lay bare in the middle of the field. The climax was around 3pm, when a heavy rain fell, and all 85 bags of rice (worth nearly 40 million VND) were soaked in water. “I went to the commune People's Committee again, hoping someone would help intervene and protect my property, but the commune officials asked me to... go home and write a petition to explain the incident. At that time, my wife and I could only cry. We didn't have time to eat, we called everywhere for help but no one helped. When we brought the petition to the commune People's Committee, the public reception officer said to leave it there and wait for the commune leaders to resolve it later (!?)”, Mr. Hung choked up.

By the next morning, May 29, when Mrs. Huong’s family agreed to let the rice be transported, it was too late. The entire amount of rice was soaked and completely damaged. During the incident, Mr. Hung repeatedly requested the Commune Police to make a record of the scene of the obstruction as legal evidence, but this was not done.

It was not until June 3 that the People's Committee of Quang Dien Commune issued a Notice in response to Mr. Hung's complaint. Accordingly, the commune authorities said that the riverbank area was disputed land, not included in the traffic planning, so there was no basis to intervene. The Notice affirmed that the incident had no signs of criminality, was only a civil dispute, beyond the commune's authority, and instructed Mr. Hung to file a lawsuit in court.

Responding to reporters, Mr. Le Van Kien, Chairman of the People's Committee of Quang Dien commune, said that the riverbank area adjacent to Mr. Hung's rice field was previously built by local people to protect the field, cultivate rice, and prevent minor floods. The police force was present at the scene but did not record any acts of property destruction, only saw Ms. Huong cursing and preventing them, so they chose the direction of "reconciliation to ensure security and order". The rice is Mr. Hung's family's property, while waiting for the local authorities to handle the case, Mr. Hung must take measures to protect himself (!?).

People do not ask the government to replace the role of the court in adjudicating land disputes. But they have the right to request timely and legal intervention to prevent violations that are happening right before their eyes. Even in the case of a disputed path waiting for court adjudication, Ms. Huong's family's obstruction of others from moving legal property, directly causing serious damage, is still a violation of the law and needs to be prevented. If the Commune Police make a record and fully record the incident, it is entirely possible to consider the signs of "destruction or intentional damage to property" according to the Penal Code to handle it in accordance with the law.

I think the competent authorities of Krong Ana district need to review the entire process of handling the case in Quang Dien commune, clarifying the responsibilities of related individuals and groups.
