The People's Committee of Quang Nam province has just announced the conclusions of Vice Chairman Tran Anh Tuan at a meeting with citizens regarding projects of Bach Dat An Joint Stock Company.

Accordingly, a group of citizens representing households who purchased land plots in three projects – the Expanded Urban Area No. 7B, Bach Dat Urban Area, and Hera Complex Riverside Urban Area – developed by Bach Dat An Joint Stock Company, complained that the investor was deliberately delaying and failing to implement the projects and fulfill its financial obligations to the State for the allocated land area. They requested that the authorities take effective measures and sanctions to compel Bach Dat An Joint Stock Company to pay its taxes.

According to representatives of households who purchased land plots in three projects of Bach Dat An Joint Stock Company, the investor has been stalling and deliberately failing to implement the projects.

According to representatives of the households, Bach Dat An Joint Stock Company shows signs of concealing and selling assets (transferring land use rights at the An Cu 1 residential area project). The group of citizens requested the Provincial People's Committee to direct measures and sanctions to seize assets and land use rights at the An Cu 1 residential area project of Bach Dat An Joint Stock Company to fulfill its financial obligations to the State and enforce judgments.

After listening to the citizens' presentations and the opinions of the attendees, Vice Chairman of the Quang Nam Provincial People's Committee Tran Anh Tuan concluded: The Provincial People's Committee and relevant provincial agencies have always focused on decisively directing and hoping that the project will be implemented and completed so that the rights of the people can be resolved. However, the investor's lack of active cooperation and coordination with relevant agencies and parties in the process of preparing documents, procedures, and resolving related issues has led to the project's delay, affecting the rights of the people.

"The State is responsible for protecting the legitimate rights and interests of the people and directing the implementation of projects in accordance with the law. When the investor and other parties do not actively and voluntarily cooperate in resolving rights and implementing the project, the government is responsible for applying sanctions and professional measures to compel the investor to implement the project or revoke the project in accordance with the law."

Regarding the delay in tax payment by Bach Dat An Joint Stock Company for the Bach Dat Urban Area project, the Provincial Tax Department has applied tax enforcement measures in accordance with the law; however, the investor has still not complied. Therefore, it is necessary to consider and apply strong, firm, and strict measures to compel the investor to comply" - excerpt from the conclusion notice.

The Quang Nam Provincial leadership has assigned the Department of Planning and Investment to take the lead, in coordination with the Provincial Tax Department, the Department of Natural Resources and Environment, the Provincial Civil Enforcement Department, and other relevant departments and agencies, to research and propose specific measures to the Provincial People's Committee to direct and handle the tax debt of Bach Dat An Joint Stock Company by early June 2023; if necessary, to advise the Provincial People's Committee to establish a working group to direct, monitor, and urge the handling of the company's tax debt and seek opinions from higher-level agencies to apply appropriate handling measures.

According to the Vice Chairman of the Quang Nam Provincial People's Committee, the projects invested by Bach Dat An Joint Stock Company have now reached the end of their planned schedule. Therefore, the Dien Ban Town People's Committee and the Dien Ban Town Land Development Center have temporarily suspended the payment of compensation and land clearance. The provincial leadership requested the Dien Ban Town People's Committee to direct the Town Land Development Center to proactively develop a plan and specific methods to expedite the payment of compensation and land clearance according to the approved plan, as well as to carry out compensation and land clearance for the remaining area when the projects are extended or when directed and agreed upon by the competent authority.

Furthermore, Mr. Tran Anh Tuan instructed the Department of Planning and Investment to urgently take the lead and coordinate with relevant departments to guide investors in carrying out the procedures according to regulations to extend the deadlines and apply measures and sanctions to urge investors to ensure the conditions for extending the projects are met; at the same time, report and advise the Provincial People's Committee to consider extending the deadlines to provide a basis for carrying out the next procedures.

Representatives of the households who purchased land plots expressed their dissatisfaction with the investor, Bach Dat An Joint Stock Company.

Notably, Mr. Tran Anh Tuan requested the Provincial Civil Enforcement Department to continue coordinating and contacting the General Department of Civil Enforcement for guidance and direction on any difficulties related to the enforcement of judgments.

Regarding the transfer of land use rights at the An Cu 1 residential area project by Bach Dat An Joint Stock Company, the Quang Nam provincial leadership has assigned the Provincial Tax Department to take the lead, in coordination with the Department of Natural Resources and Environment, the People's Committee of Dien Ban town, and the Provincial Civil Enforcement Department, to inspect and consider the seizure of assets at the An Cu 1 residential area project to fulfill tax obligations to the State and enforce judgments in accordance with the law.

As VTC News has reported numerous times, disputes have arisen between Bach Dat An Joint Stock Company (the investor) and Hoang Nhat Nam Investment Joint Stock Company (the broker) over three projects in Dien Ban town: the expanded Urban Area No. 7B, Bach Dat Urban Area, and Hera Complex Riverside Urban Area. This is considered one of the largest real estate disputes in Central Vietnam, involving approximately 1,100 land plots that have been sold, generating around 700 billion VND in revenue.

After numerous trials from the first instance to the appeal, the People's Courts at all levels rejected the lawsuit filed by Bach Dat An Joint Stock Company, compelling the company to continue fulfilling the contract, promptly implement the projects, and hand over the land and land use right certificates to the people. However, to date, the investor has still not handed over the land and land use right certificates to customers who purchased land in the project.
