Issuing regulations on liquidation of planted forests for forest areas planted with the State budget

The Government has just issued Decree No. 140/2024/ND-CP dated October 25, 2024, regulating the liquidation of planted forests. This Decree has removed regulations on forest liquidation for planted forest areas using the State budget, which had not previously been issued by competent authorities on forest liquidation.

Accordingly, Decree No. 140/2024/ND-CP stipulates the order and procedures for liquidation and management and use of proceeds from liquidation of planted forests using the State budget.

After storm Yagi , many areas of Cao Van Lake protective forest (Cam Pha City) were completely destroyed.

To implement Decree No. 140/2024/ND-CP, currently, the State management unit on forestry, the Department of Agriculture and Rural Development, will advise the Provincial People's Committee to submit a report to the Provincial People's Council for approval to develop a plan to implement Decree No. 140/2024/ND-CP. The People's Council of Quang Ninh province will submit a report to develop a resolution of the Provincial People's Council to issue regulations on the authority to decide on the liquidation of planted forests for the Provincial People's Committee. Based on the above legal framework, the Department of Agriculture and Rural Development will report to the Provincial People's Committee to implement Decree No. 140/2024/ND-CP, and at the same time provide guidance to localities and forest owners on the liquidation of planted forests using state budget capital.

It is known that in the whole Quang Ninh province, every year, there is an area of forest planted with State budget capital that needs to be liquidated, because the forest trees have reached the age of degradation.

In particular, after Typhoon Yagi hit Quang Ninh in early September, over 10,000 hectares of forests planted with state budget funds were destroyed. These forest areas need to be liquidated to collect timber from the forest (for forests that have generated timber reserves after investment) to recover capital for the state or to liquidate the forest to facilitate clearing of vegetation and forest sanitation (for forests in the investment phase) to prevent the risk of forest fires and quickly create areas for new forest planting, especially in upstream protection forests, which have the function of creating water sources for irrigation reservoirs.
