Ministry of Health warns and corrects violations in psychiatric assessment

The Ministry of Health has just issued a document requesting medical facilities to strengthen the management of forensic examination, psychiatric examination and compulsory treatment activities at specialized facilities.

Faced with the reality of cases related to falsifying psychiatric medical records, accepting bribes for medical examinations, organizing illegal drug use in treatment facilities... causing public outrage, the Ministry of Health has just issued a document requesting medical facilities to strengthen the management of forensic examination, psychiatric examination and compulsory treatment activities at specialized facilities.

The Ministry requests the Department of Health of provinces and cities and medical units under the ministry and branches to disseminate, thoroughly understand and closely monitor the implementation of the above contents at all specialized psychiatric medical facilities and forensic psychiatric assessments under their management.

According to the Ministry of Health, there have been many serious violations in the field of appraisal, especially forensic psychiatric appraisal. Some cases have signs of criminality such as falsifying medical records to help subjects avoid criminal liability, accepting bribes to change appraisal conclusions, and even organizing illegal drug use right in compulsory treatment facilities.

These acts not only violate the law but also erode people's trust in the health system, seriously damaging the strictness of the law.

In order to rectify all assessment and treatment activities in the field of psychiatry, the Ministry of Health requires psychiatric hospitals, forensic psychiatric centers, forensic assessment institutes and forensic psychiatric clinics nationwide to strictly implement Directive No. 07/CT-BYT dated September 9, 2024.

In particular, the head of the unit will be fully responsible before the law if any violations related to compulsory assessment or treatment occur.

The Ministry of Health emphasizes the requirement that forensic and forensic psychiatric examination organizations must follow proper professional procedures, ensuring accuracy, objectivity and honesty.

Receiving requests for appraisal must comply with the Law on Judicial Appraisal and related guiding documents. Appraisers must be appointed, have a legal appraiser card and only perform their duties when meeting the prescribed conditions.

Units need to closely coordinate with investigation agencies, prosecutors and local authorities during the process of compulsory assessment and treatment.

The handover of the appraisal conclusion shall only be carried out after the complete dossier is completed according to regulations, handed over to the right competent person and in accordance with legal procedures. In particular, it is necessary to avoid the situation of intentionally "legalizing" the dossier for cases that do not meet the conditions.

In the compulsory treatment at specialized psychiatric medical facilities, the Ministry of Health requires units to review all professional procedures, update treatment regulations and sign professional contracts with qualified medical facilities. Hospital or inter-hospital consultations must be organized when there is a request to suspend compulsory treatment from the competent authority.

At the same time, strict security must be ensured at the treatment facility with a three-layer safety door system, continuous surveillance cameras, and strict control of patients to avoid escape or outside assistance. Regulations on patient visits must be strictly implemented, and prohibited items and substances must not be allowed into the treatment facility.

The Ministry also noted that the issuance of mental health certificates can only be done at assigned facilities, according to prescribed forms, and that no individual form of examination certificate can be arbitrarily designed.

The head of the facility will be held responsible if there is a situation where the wrong medical examination form is issued, fake documents are issued, or documents are issued to subjects who have not actually been examined. This is one of the loopholes that can be easily exploited to avoid criminal liability, or to serve illegal purposes.

Along with management solutions, the Ministry of Health also requires strengthening internal inspection, supervision and monitoring at mental health assessment and treatment facilities. Collectives and individuals who perform their duties well will be promptly commended and rewarded; conversely, violations will be strictly handled in accordance with legal regulations.

Finally, the Ministry requests the Department of Health of provinces and cities and medical units under the ministry and branches to disseminate, thoroughly understand and closely monitor the implementation of the above contents at all specialized psychiatric medical facilities and forensic psychiatric assessments under their management.

The Ministry of Health affirms that counterfeit drugs, fake documents or fake psychiatric records are all serious violations of the law, causing serious consequences not only for individuals but also for the whole society. To thoroughly prevent these violations, there needs to be close coordination between state management agencies, prosecution agencies, the health sector and supervision by the whole society.
