Ministry of Health reviews and rectify bidding documents

The Ministry of Health has just sent an official dispatch to its affiliated and subordinate units and project programs regarding the rectification, enhancement of capacity and effectiveness of bidding and contractor selection.

Review and rectify the work of preparing bidding documents

In the official dispatch, the Ministry of Health requested that heads of units under and directly under the Ministry of Health continue to fully and synchronously implement solutions on contractor selection.

Regarding the resolution of some newly arising or unresolved shortcomings, limitations and inadequacies, the Ministry of Health requires units when receiving imported goods such as medical equipment, supplies, biological products, test kits... from contractors to ensure the correct list, type, origin, manufacturer, year of manufacture, model, serial and accompanied by legal documents according to the provisions of current law on bidding, bidding documents and according to the contract signed between the parties to prove the validity of imported goods such as: certificate of origin (C/O), certificate of quality (C/Q), customs declaration, packing list, invoice, bill of lading, certificate of analysis (COA Certificate Of Analysis)...

Units shall review and rectify the preparation of bidding documents, ensuring publicity and transparency, avoiding the situation of making subjective requirements and criteria that do not ensure competitiveness, leading to limiting the participation of contractors or creating advantages for one or several contractors, causing unfair competition, violating the provisions of Clause 2, Article 12 of Decree No. 63/2014/ND-CP of the Government .

The Ministry of Health stated that the implementation of online bidding must ensure that both the number of bidding packages and the value of bidding packages are met compared to the online bidding roadmap specified in Circular No. 08/2022/TT-BKHÐT dated May 31, 2022 of the Minister of Planning and Investment detailing the provision and posting of information on bidding and contractor selection on the National Bidding Network System.

Attaching responsibility to the leader with the results of bidding work

Regarding the solution for organizing bidding and selecting contractors, the Ministry of Health requires promoting the full and accurate disclosure of information and organizing the selection of contractors online on the e-GP system.

Units should strengthen and diversify training and fostering of legal policies on bidding and contractor selection (especially online bidding) to improve capacity, expertise, and standardize the quality of staff working in bidding, ensuring that they have sufficient qualifications and experience to meet the requirements of bidding packages and projects.

At the same time, strengthen the inspection, examination, supervision and monitoring of contractor selection, especially for bidding packages and projects with few bidders and low savings rates; cases where a contractor wins many bidding packages at a unit, an investor, or an inviting party for a long time. In case of detecting signs of law violations, promptly take measures to handle them in accordance with the provisions of law.

Units that have rectified the work of preparing and submitting regular and ad hoc reports, especially annual reports as required by the Ministry of Planning and Investment, have been instructed on how to make reports on the system (from account registration to decentralization of reporting).

The Ministry of Health said that many units have proactively and effectively implemented reporting to ensure compliance with requirements on forms, progress and quality. However, some units still have to receive many written reminders about reporting.

Therefore, the Ministry of Health requires unit leaders to pay attention and learn from experience to avoid late submission or incomplete reporting, incorrect forms, or inaccurate bidding data to the Ministry of Health in order to promptly synthesize and send to the Ministry of Planning and Investment, to report to the Prime Minister or to report to inspection and examination agencies.

The Ministry of Health requests units to continue to seriously implement the Prime Minister's instructions in Directive No. 13/CT-TTg dated April 4, 2017 on increasing the use of domestically produced materials and goods in bidding for development investment projects and regular procurement activities using state capital and Directive No. 47/CT-TTg dated December 27, 2017 on rectifying bidding in development investment projects and regular procurement activities using state capital.

At the same time, attach responsibility to the head of the organization with the results of the bidding work within the scope of responsibility, especially the heads of agencies and units with many years of low bidding savings rate, many recommendations, complaints and complex denunciations. The head of the unit is responsible for proactively resolving difficulties and problems, handling situations according to the provisions of law; strengthening inspection, supervision and individualizing personal responsibility, overcoming the situation of avoidance, not consulting, not proposing, shirking responsibility...

The Ministry of Health said that recently, medical units conducting bidding and selecting contractors still had shortcomings and violations in the management and organization of purchasing equipment, medical supplies, medical biological products, test kits, vaccines, and drugs.

The development and promulgation of a number of documents regulating bidding for the procurement of drugs and medical equipment are still inadequate, causing difficulties and confusion for investors, bidding parties and contractors.

The Ministry of Health believes that the main cause of the above situation is the inadequacy of some regulations such as not being allowed to buy or sell medical equipment without a declared price and not being allowed to buy or sell at a price higher than the declared price on the Ministry of Health's electronic information portal at the same time./.
