Lam Dong Provincial People's Committee has just assigned the Department of Finance to preside over and coordinate with the Department of Construction and relevant units to study the proposal of the Ministry of Finance in Official Dispatch No. 8280/BTC-DT dated June 12, 2025 on investing in the project to build the Nha Trang (Khanh Hoa province) - Da Lat (Lam Dong province) expressway under the PPP method.
In Document No. 8280/BTC-DT dated June 12, 2025, regarding the conformity with the planning and the need to soon invest in the Nha Trang ( Khanh Hoa ) - Da Lat (Lam Dong) expressway, the Ministry of Finance said that in Decision No. 1454/QD-TTg dated September 1, 2021 of the Prime Minister, the Nha Trang (Khanh Hoa) - Lien Khuong (Lam Dong) expressway is planned to have a length of 85 km, a scale of 4 lanes invested in the period after 2030 (CT.25).
According to the report of the Ministry of Construction in Document No. 3037/BXD-KHTC dated May 6, 2025 mentioned above, the People's Committees of Khanh Hoa province and Lam Dong province proposed to adjust the length of the Nha Trang - Lien Khuong expressway to 99 km, without changing the end point (in which the Nha Trang - Da Lat expressway invested under the PPP method has a length of 80.8 km); at the same time, it is reported that the investment in the Nha Trang - Da Lat expressway before 2030 is a basis for consideration.
The Ministry of Finance requested the Ministry of Construction to coordinate with relevant localities to be responsible for specifically assessing and clarifying the necessity of investing in the route and the feasibility of adjusting the planning of the Nha Trang - Lien Khuong expressway, speeding up the investment process of the Nha Trang - Da Lat expressway project belonging to the CT.25 expressway before 2030 according to the proposal of the locality, clearly affirming the viewpoint of the Ministry of Construction as a basis for reporting to the Prime Minister for consideration and decision.
In addition, the Ministry of Finance requested the Ministry of Construction and relevant localities to consider and carefully evaluate the need for investment in the context of implementing mergers between localities and completing the two-level local government model.
According to the report of the Ministry of Construction, in Submission No. 11614/LT-KH-LD dated October 15, 2024 of the joint People's Committee of Khanh Hoa and Lam Dong provinces, the Nha Trang - Da Lat Expressway Project is under the authority of the National Assembly to approve the investment policy (The project uses a special-use forest area of 99.9 hectares).
However, the Ministry of Finance found that the Nha Trang - Da Lat Expressway Project has not yet identified a competent authority, and has not assigned the project preparation unit to prepare a pre-feasibility study report, determine the total preliminary investment, state capital participating in the project..., as a basis for appraisal, submission to competent authorities for approval of the investment policy and implementation of the next steps.
In Clause 4, Article 21 of Decree No. 35/2021/ND-CP dated March 29, 2021 of the Government (amended and supplemented at Point a, Clause 6, Article 1 of Decree No. 71/2025/ND-CP dated March 28, 2025) it is stipulated that for PPP projects implemented in the area of two or more provincial-level administrative units in the cases specified in Point b, Clause 4 or Point b, Clause 4a, Article 12 of the PPP Law, the Prime Minister shall delegate authority to the Minister of the sectoral management ministry to have a consensus on assigning an agency as the competent authority.
Therefore, the Ministry of Finance requests the People's Committee of Khanh Hoa province to coordinate with the People's Committee of Lam Dong province to propose and report to the Minister of Construction for consensus on assigning competent authorities to implement the Project in accordance with the authority, order and procedures prescribed by law on PPP and road traffic.
According to the report of Khanh Hoa Provincial People's Committee, the Nha Trang - Da Lat Expressway Project requires state capital participation of about 17,541 billion VND (accounting for 70% of the total preliminary investment).
Of which, the central budget capital in the medium-term public investment plan for the period 2026 - 2030 is 16,370 billion VND; the local budget capital allocated for site clearance is 1,171 billion VND.
According to the provisions of Point d, Clause 1, Article 14 of the Law on Investment under the Public-Private Partnership Form No. 64/2020/QH14 (amended and supplemented at Point a, Clause 7, Article 3 of Law No. 57/2024/QH5), the conditions for selecting a project for investment under the PPP form include the ability to arrange state capital in case the project needs to use state capital or the ability to arrange state budget sources.
The Government issued Directive No. 25/CT-TTg dated August 8, 2024 on the development of the Medium-term Public Investment Plan for the period 2026 - 2030, and the National Assembly Standing Committee issued Resolution No. 70/2025/UBTVQH15 dated February 7, 2025 on principles, criteria and norms for allocating public investment capital from the state budget for the period 2026 - 2030.
Therefore, the Ministry of Finance requests the Ministry of Construction and the People's Committee of Khanh Hoa province, based on the authority of the agency assigned to implement the Project, to study and register the capital demand allocated for the Project in the Medium-term Public Investment Plan for the period 2026 - 2030 according to regulations.
According to the Ministry of Finance, the ability to balance the state budget for development investment in the period of 2026 - 2030 has not been decided by the competent authority. Therefore, there is no basis to assess the ability to balance the state capital allocated for the Project. The Ministry of Finance acknowledges the capital needs of the Project and will synthesize a report to the competent authority in accordance with the provisions of relevant laws.
“Because the central budget currently has to undertake many other important and urgent spending tasks, we propose that the People's Committees of Khanh Hoa and Lam Dong provinces, based on regulations and authority, continue to study the possibility of balancing and increasing the local budget capital expected to be allocated to the Project, and report to competent authorities for consideration and decision to ensure the feasibility of the Project,” said a representative of the Ministry of Finance.
Regarding the level of State capital participating in the Project, Khanh Hoa Provincial People's Committee proposed that the maximum rate of State capital participating in the Project is 70% of the total investment as prescribed in Point c, Clause 16, Article 3 of Law No. 57/2024/QH15.
However, according to the opinion of the Ministry of Finance, the specific proportion of state capital participating in the Project will be determined and clarified by the competent authority during the process of appraisal and approval of the Project investment policy according to the provisions of the law on PPP, the state budget and relevant legal provisions.
