Delivery no later than June 30

The Ministry of Finance has just sent an official dispatch to the People's Committees of provinces and centrally-run cities providing additional guidance on the arrangement, organization, and handling of headquarters and public assets when implementing administrative unit arrangements.

Accordingly, to speed up the progress, the Ministry of Finance said that in case the plan for arranging, distributing and handling assets has been approved by the competent authority but during the implementation process there is a change in the form (plan) of arranging, distributing and handling assets to comply with new regulations or practical requirements, the report must be submitted to the competent authority on management and use of public assets for consideration and decision on handling without having to report to adjust the plan.

It is not necessary to carry out procedures for preparing, reporting, checking the current status, synthesizing, and approving plans for rearranging and handling houses and land according to Decree No. 03 of the Government when developing and implementing plans for arranging, distributing, and handling assets when rearranging administrative units.

The Ministry of Finance requires that, no later than June 30, administrative agencies under district-level administrative units must complete the handover of headquarters, public assets and related records and documents to competent agencies, organizations and units, to avoid interruption of management work, loss of assets, and impact on state management and provision of public services.

Based on the approved plan for arrangement, disposition, and handling of assets managed by the district level, agencies, organizations, and units shall carry out the handover and receipt of assets according to their assigned responsibilities; upon completion, the unit receiving the assets shall be responsible for preparing a report to the Provincial People's Committee to decide on the handover of assets to the agency, organization, or unit for management and use.

From July 1, the new provincial People's Committee after the merger or consolidation is responsible for inheriting all the powers and responsibilities of the provinces/cities before the merger or consolidation.

Houses and land must be used and exploited, avoid leaving them vacant.

For houses and land facilities that are handled according to the plan assigned to local organizations with the function of managing and trading houses, local land fund development organizations for management, after handing over to these organizations, the agency or unit with the function of advising is responsible for reporting to the Provincial People's Committee for consideration and decision on the plan for handling and exploiting houses and land.

In particular, it is necessary to ensure that all housing and land facilities are used, exploited and processed in accordance with regulations, avoiding vacancy and waste.

The conversion of public property functions (including conversion of office buildings and public service facilities to infrastructure assets) is carried out in accordance with the provisions of Article 13 of Decree No. 151 of the Government or amendments, supplements or replacements (if any).

Adjustment of land use planning, construction planning and other plans and schemes when converting the function of public assets (if any) shall be carried out in accordance with regulations and instructions of the Ministry of Agriculture and Environment, the Ministry of Construction and relevant specialized management ministries.

In case ministries, central agencies and People's Committees of provinces and centrally-run cities have agreed to exchange (transfer) working headquarters and public service facilities that need to be implemented immediately to meet the requirements of organization arrangement and streamlining, they must temporarily hand over and accept them for timely use; complete procedures to submit to competent authorities for decision on transfer within 30 days from the date of temporary handover and acceptance.

Receive houses and land facilities that are decided to be recovered by ministries and central agencies, and transfer them to local management and handling for preservation, exploitation and handling within the prescribed time limit.
