The Department of Drug Administration, Ministry of Health has just issued Official Dispatch No. 3141/QLD-MP to the Department of Health of centrally-run provinces and cities regarding strengthening the management of cosmetics.

Accordingly, currently, through the inspection and examination of compliance with the law on the production and trading of cosmetics, there are still some establishments producing and trading cosmetics that do not match the address in the declaration dossier. In addition, when changing the production and trading location, the production and trading establishments do not report to the management agency as prescribed.
Through inspection, there are establishments that have not fully complied with the conditions for cosmetics production; produced and traded substandard cosmetics, cosmetics that have not been granted a receipt number for the Declaration Form by the competent State management agency according to regulations; some cosmetic products have stated features and uses that are misleading as drugs...
On the other hand, through the reflection of media agencies, on the internet, e-commerce trading floors and social networks, there is a situation of trading in cosmetic products that are hand-carried, fake, and of unknown origin. The advertised products do not match the features and uses as licensed.
To effectively manage cosmetics, ensure safety and benefits for users, the Drug Administration requires units to strengthen inspection and examination of cosmetics production and trading in the area.
At the request of the Drug Administration, relevant agencies need to proactively coordinate closely with the local Steering Committee 389, the Market Management Department and relevant local authorities to strengthen the inspection and examination of cosmetics circulating on the market.
In particular, the orders focus on inspecting the production and trading of cosmetics on e-commerce trading floors and social networks Facebook, TikTok, Zalo, Youtube... to promptly detect and handle illegal production and trading of cosmetics, fake cosmetics, unlicensed cosmetics, excessive advertising...
The Drug Administration also requires strict handling and punishment of organizations and individuals who violate the law; at the same time, recall and destroy all cosmetics of unknown origin and origin, and those that do not meet quality standards.
Previously, the Ministry of Health issued Directive No. 3873/BYT-VPB on this issue, stating that through information from the press, recently, a number of cases related to the detection and handling by authorities of a number of establishments producing and trading in counterfeit cosmetics and cosmetics of unknown origin that were bought and sold on social networking sites, causing confusion among consumers. To overcome the above situation, the Ministry of Health has assigned tasks to the Department of Drug Administration, the Ministry of Health Inspectorate and the Departments of Health of provinces and cities.
The Ministry of Health requests the Department of Health of provinces and cities to strictly implement administrative procedures on granting acceptance numbers for domestically produced cosmetic product declaration forms; granting certificates of eligibility for cosmetic production; and re-issuing certificates of eligibility for cosmetic production to ensure timeliness and avoid causing inconvenience to businesses.
Strengthen inspection, examination and post-inspection of the implementation of regulations by enterprises in the process of production and distribution of cosmetic products, focusing on the issue of origin and advertising information.
At the same time, proactively coordinate with local market management agencies to inspect and promptly detect cases of production and trading of fake cosmetic products, counterfeit brands or false advertising, exceeding the scope of published uses, and strictly handle violations.
