20 months early retirement benefits

(Chinhphu.vn) - Mr. Le Quang (Thanh Hoa) is currently the Party Secretary of the commune, has submitted an application for early retirement from June 1, 2025, with 20 months left until retirement age according to the Law on Social Insurance.

Mr. Quang asked, am I entitled to the support policy according to Decree No. 67/2025/ND-CP (amending Decree 178/2024/ND-CP)? Will I be supported with 5 months of salary for each year of early retirement, 5 months of salary for the first 20 years of work, and 0.5 months of salary each year from the 21st month onwards, or will I only receive 20 months of salary for the month of early retirement?

Regarding this issue, the Ministry of Home Affairs responded as follows:

Pursuant to the provisions of Article 2 and Article 7 of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of the organizational arrangement of the political system (amended and supplemented in Decree No. 67/2025/ND-CP dated March 15, 2025 of the Government), cadres who are not old enough to be re-elected or re-appointed, have less than 2 years of age to the retirement age prescribed in Appendix I issued together with Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating the retirement age and have enough working time with compulsory social insurance contributions to receive pensions according to the provisions of the law on social insurance, are subject to the regimes and policies prescribed in Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP).

Therefore, in the case of Mr. Le Quang, currently the Party Secretary of the commune, the retirement age according to the Law on Social Insurance is 20 months away. If he wishes to retire early to create conditions for arranging personnel for the Party Committee in the Party Congresses at all levels leading up to the 14th National Congress of the Party and is approved by the competent authority, based on the provisions of Point d, Clause 2, Article 7 of Decree No. 178/2024/ND-CP, Clause 8, Article 1 of Decree No. 67/2025/ND-CP, he will be entitled to pension benefits according to the provisions of the law on social insurance and will not have his pension rate deducted due to his early retirement; in addition, he will be entitled to a one-time pension benefit for the early retirement period compared to the retirement time specified in Appendix I issued with Decree No. 135/2020/ND-CP (equal to 20 months of current salary).
