The revised Construction Law Project was reviewed and commented on by the National Assembly Standing Committee at the meeting on the afternoon of October 16.
According to Deputy Minister of Construction Bui Xuan Dung, this draft law amends regulations on construction permit issuance in the direction of expanding the subjects exempted from construction permits.
Accordingly, the project is subject to appraisal by the specialized construction agency, not requiring a construction permit. For example, the project is a public investment project, a PPP project, a large-scale business investment project or a project that has a major impact on safety and community interests.

For the remaining works, the State management agency on construction shall manage through construction permit procedures.
The draft amended law also simplifies administrative procedures regarding the order and conditions for granting construction permits; minimizing the time for granting permits (expected to be a maximum of 7 days).
From the side of the examining agency, Vice Chairman of the Committee for Science, Technology and Environment Tran Van Khai said that there are opinions that construction permits are not a “barrier” but a tool to protect rights and social order. The problem lies in the quality and licensing process. Therefore, it is necessary to simplify the process, clearly define responsibilities, processing time limits and publicize information for people and businesses to monitor.
Exemption from construction permits, according to Mr. Khai, helps reduce procedures but it is necessary to perfect legal regulations in the Construction Law or Land Law to ensure property ownership rights on land.

In addition, the inspection agency believes that it is necessary to supplement a mechanism to handle violations of licensed works that are constructed incorrectly according to design, have their functions changed, or violate regulations, ensuring consistency and clarity of responsibilities among relevant parties.
Expressing his views on this content, Chairman of the Delegation Work Committee Nguyen Thanh Hai shared his concerns when converting the mechanism from pre-control to post-control.
Although this is a very positive step forward in modern management, according to Ms. Hai, there are also concerns about the risk of reducing efficiency when implemented in practice. According to her, if there is no synchronization with other laws, it will lead to a situation where investors have to face many inspection agencies.
Sharing the same view, Chairman of the Law and Justice Committee Hoang Thanh Tung is concerned about potential risks to construction quality when many procedures for granting construction permits are cut.
He noted that along with the reduction, there should be solutions to improve the capacity and responsibility of investors, and measures to minimize the risk of changing construction designs after appraisal. At the same time, it is necessary to prescribe strong sanctions and a strict post-inspection mechanism for projects that greatly affect safety and community interests.

National Assembly Chairman Tran Thanh Man also proposed studying clear regulations on post-inspection to avoid abuse or lax inspection.
The National Assembly Chairman pointed out that many errors and violations in construction arise not because of the construction licensing mechanism but because of the lack of transparency and inconsistency in regulations on types of licensed works, conditions and licensing authority.
Therefore, the National Assembly Chairman suggested that attention should be paid to the quality, methods, and licensing procedures, so that construction permits are not a barrier or a procedure that causes trouble for people and businesses.
