Close management of civil servants by job position, consider dismissal if not completing tasks

On the morning of June 24, the 15th National Assembly voted to pass the Law on Cadres and Civil Servants (amended) with 418/423 delegates participating in the vote in favor.

Minister of Home Affairs Pham Thi Thanh Tra presented a report explaining, accepting and revising the draft law.

The draft Law on Cadres and Civil Servants (amended) submitted to the National Assembly for approval consists of 7 Chapters and 45 Articles (8 Articles less than the draft Law submitted to the National Assembly for comments).

Presenting the report on explanation, acceptance and revision of the draft law, Minister of Home Affairs Pham Thi Thanh Tra said that, based on the acceptance of delegates' opinions, the draft Law has demonstrated innovative thinking, creating a synchronous legal corridor for civil servant management in a dynamic, transparent and effective direction, meeting the requirements of the task in order to build a team of professional cadres and civil servants, serving well the cause of socio -economic development and the needs of people and businesses.

National Assembly delegates vote to pass the Law on Cadres and Civil Servants (amended)

The Law supplements and perfects regulations to transform the method of managing cadres and civil servants according to job positions, taking job positions as the center, on the basis of job position requirements and results and products of task performance to recruit, arrange, use, evaluate, train, plan, and appoint cadres and civil servants.

The Law has supplemented the mechanism for attracting high-quality human resources and policies for talented people in public service to institutionalize Resolutions No. 57-NQ/TW dated December 22, 2024, No. 66-NQ/TW dated April 30, 2025 and No. 68-NQ/TW dated May 4, 2025 of the Politburo.

Specifically, policy regulations for 2 groups of subjects include: Attracting to the public sector applies to high-quality human resources and talented people in public service activities.

Three forms of attracting high-quality human resources outside the public sector include: Admission into the civil service; signing contracts with typical and excellent businessmen, good lawyers, experts, scientists to perform one or several tasks of a leadership or management position; and signing contracts with high-quality human resources to perform one or several professional and technical tasks.

In addition, the Law supplements and adjusts regulations on job positions and civil servant ranks to attract high-quality human resources from the private sector, encourages civil servants to develop in a professional and technical path without necessarily having to be appointed to leadership and management positions and titles; clarifies the principles, authority, content, and methods of assessing and classifying the quality of civil servants on the basis of regular, continuous, multi-dimensional, and quantitative monitoring and evaluation using specific criteria associated with progress, quantity, and quality of results and products according to job positions; uses assessment results to implement rewards, additional income regimes, bonuses, or consider assigning to lower job positions or dismissing people who do not meet job requirements from the apparatus...

This Law takes effect from July 1, 2025 (except for the provisions on civil servant assessment in Section 3, Chapter IV of the Law which will take effect from January 1, 2026).
