National Assembly Chairman: Changing thinking and approach in law making

VOV.VN - On the morning of September 17, at the National Assembly House, a conference of the National Assembly Party Delegation and the Government Party Committee took place on preparations for the 8th Session of the 15th National Assembly. Secretary of the National Assembly Party Delegation, Chairman of the National Assembly Tran Thanh Man and Secretary of the Government Party Committee, Prime Minister Pham Minh Chinh co-chaired the conference.
In his opening speech, National Assembly Chairman Tran Thanh Man said that the 8th Session has the most content of all sessions since the beginning of the 15th National Assembly's term. The National Assembly will consider 39 contents, including 29 contents related to legislative work, 10 groups of contents on socio -economics, state budget; supervision, personnel work and other issues. The 8th Session is expected to open on October 21 and last for 29 days, organized in 2 phases.

The National Assembly Chairman said that the conference was held one month before the session so that the drafting and reviewing agencies have time to implement it in accordance with the Law on Promulgation of Legal Documents; at the same time, it is to discuss and agree on the content of the 8th Session's agenda, especially the agencies giving opinions on the progress, time, and quality according to regulations, and the preparation of the content of draft laws and resolutions to be added to the 8th Session's agenda according to the shortened agenda.

According to National Assembly Chairman Tran Thanh Man, in recent times, the coordination between the Government and the National Assembly agencies has become increasingly close, smooth, substantial and effective. The agencies have promoted a sense of responsibility, prepared early, from afar, and worked day and night to prepare for draft laws and resolutions to be submitted to the National Assembly. In the current context, National Assembly Chairman Tran Thanh Man especially noted that the recent storm No. 3 had very complicated developments, the consequences were very severe and up to this point, the damage has not been fully calculated. The entire Party, people and army have encountered new difficulties and challenges. The Government must face additional difficulties and pressures in budget revenue and expenditure, achieving growth targets, ensuring macroeconomic stability of the economy, controlling inflation and increasing prices of goods to ensure people's lives. "Therefore, the National Assembly Party Delegation and the Government Party Committee continue to coordinate substantively, effectively, and institutionally in a timely manner, meeting practical requirements for socio-economic development, ensuring people's lives and promoting growth," the National Assembly Chairman emphasized. Considering that the time to implement the 5-year socio-economic plan is only over 1 year away, in addition, the impact of storm No. 3 is very severe, the National Assembly Chairman requested that it is necessary to promptly handle difficulties and problems that arise. Any issues that the Government manages, the Government will decide. Any content that is beyond the authority of the Government, the National Assembly will be consulted with the National Assembly Standing Committee and the National Assembly. The National Assembly Chairman emphasized that all are in the spirit of the direction of General Secretary andPresident To Lam, that is, the law-making must come from practice, while doing, learn from experience, not be perfectionist, not hasty. Take people and businesses as the center and subject. Timely remove difficulties and institutional problems to unblock resources, resolve and overcome bottlenecks. All for socio-economic development, ensure national defense and security, ensure people's lives. The National Assembly Chairman also said that the National Assembly agencies are always ready to receive research dossiers on draft laws and resolutions submitted by the Government. However, the quality of draft laws and resolutions is primarily due to the drafting agencies of the Government. At the same time, the Ethnic Council, the Committees of the National Assembly, the Vice Chairmen and the Chairmen of the National Assembly must work continuously to ensure smooth, substantive, quality and effective coordination. For issues that are unclear, inconsistent, and have different opinions, the drafting agencies and the reviewing agencies must sit together many times, in a spirit of building, exchanging and debating with scientific and practical arguments, to reach a consensus on the plan. The National Assembly Chairman also noted that the heads of ministries and branches need to follow up on draft laws and resolutions to the end, avoiding the situation of appointing this person today and another person tomorrow. Regarding this content, National Assembly Chairman Tran Thanh Man also said that it is necessary to amend the Law on Promulgation of Legal Documents, especially changing the mindset and approach in law-making, ensuring simplification, increasing decentralization, decentralization, speeding up progress... so that the matters that are not unified or not in agreement between the reviewing and drafting agencies will be carried out in the spirit of "however difficult it is, we will solve it".
Effective management, contributing to development
After listening to the discussion, Prime Minister Pham Minh Chinh highly appreciated the increasingly good coordination between the National Assembly Party Delegation and the Government Party Committee; said that the conference aimed to review the remaining work, which needed to be unified, to promote and improve the quality of the session. Therefore, the Prime Minister suggested that the two sides need to have good coordination from the stage of drafting laws and resolutions. The Prime Minister also requested ministries and branches to actively, proactively, and closely and effectively coordinate with the Ethnic Council and the Committees of the National Assembly. Accordingly, in addition to institutionalizing and concretizing the Party's guidelines and policies for implementation, agencies must continue to innovate their thinking in law-making, from focusing only on management work to focusing on effective management work, while also contributing to development creation. "I see the need for innovation in drafting agencies as well as appraisal agencies, on that basis, to mobilize all resources. Currently, resources are congested. It is good that we focus on effective management. However, in addition, we must open up new spaces, create for development, to mobilize all resources of society and people," the Prime Minister emphasized. The Prime Minister said that, depending on the nature of each draft law, detailed regulations can be issued, but for issues that are still fluctuating and have many impacts, it should be generalized. Legislative work must be carried out in the spirit of what is clear, mature, proven to be correct in practice, effectively implemented and agreed by the majority, then it should be legalized. As for issues that are not yet ripe, unclear, still fluctuating in practice, complicated and unpredictable, then boldly pilot, while doing, learn from experience, and gradually expand. In addition, it is necessary to focus on decentralization, decentralization along with resource allocation, improve implementation capacity, and design tools to strengthen supervision and inspection. With the spirit of enhancing responsibility, daring to think, daring to do and decentralization, ministries, branches and localities must decide and implement effectively. According to Prime Minister Pham Minh Chinh, when clearly assigning people, tasks, responsibilities, time, and products, it will be easier to inspect, evaluate, and classify. Therefore, thorough decentralization will increase accountability and encourage innovation. The Prime Minister also requested to reduce administrative procedures, eliminate the mechanism of asking and giving, especially not creating an environment that leads to corruption and negativity. Concluding the Conference, National Assembly Chairman Tran Thanh Man requested that the drafting agencies send documents to the National Assembly before October 1; in which special attention should be paid to the 6 contents presented at a session to ensure quality. The National Assembly Chairman requested the Office of the National Assembly Party Delegation to coordinate with the Office of the Government Party Personnel Committee to synthesize issues to request opinions from competent authorities in the coming time. Once again, the National Assembly Chairman noted that the drafting agencies need to speed up the completion of documents submitted to the National Assembly. For its part, when there are draft laws and resolutions, the National Assembly will work day and night, including Saturdays and Sundays.
