The Decision also amends and supplements 3 procedures within the scope of the Ministry's functions and tasks, including: 2 provincial-level procedures are the order and procedures for developing the first land price list for announcement and application from January 1, 2026 and adjusting, amending and supplementing the annual land price list for announcement and application from January 1 of the following year and specific land valuation procedures for cases under the authority of the Chairman of the Provincial People's Committee; 1 commune-level procedure is the specific land valuation procedure for cases under the authority of the Chairman of the Commune People's Committee.
Accordingly, in the procedures for developing the first land price list for announcement and application from January 1, 2026 and adjusting, amending and supplementing the annual land price list for announcement and application from January 1 of the following year, the agency deciding on the land price list is transferred from the Provincial People's Committee to the Provincial People's Council.
This procedure includes 16 steps, in which the first step is for the land management agency to prepare a project to develop a land price list, determine the content, progress, and budget. Next is to prepare an appraisal dossier to send to the Department of Finance for appraisal; in which, the Department of Finance is responsible for appraising and sending the appraisal document of the project dossier to develop a land price list to the competent land management agency.
At the same time, the competent land management agency receives and completes appraisal opinions and submits to the provincial People's Committee the project dossier for building the land price list. The provincial People's Committee directs relevant departments, branches, localities, and management boards to organize implementation.
In addition, the provincial-level land management authority shall decide to place orders and assign tasks to qualified public service units to provide land price determination consultancy services or select land price determination consultancy organizations in accordance with the provisions of the law on bidding to develop land price lists.
Next, the Department of Finance submits to the Chairman of the Provincial People's Committee the composition of the Land Price Appraisal Council as prescribed in Clause 1, Article 161 of the Land Law to appraise the draft land price list. Then, the Department of Finance submits to the Chairman of the Land Price Appraisal Council the decision to establish a Working Group to assist the Council.
The steps for organizing the implementation of land valuation to build a land price list are specifically guided. Accordingly, it is necessary to investigate, survey, and collect information to serve the construction of a land price list by area and location; the construction of a land price list for each plot of land based on the value area, standard land plot and determining the land type, area, and location of land in each commune and ward for the area to build a land price list by area and location; determining the land type, total number of land plots, and number of land plots of each type of land for the area to build a land price list for each plot of land based on the value area and standard land plot.
On that basis, synthesize and complete the records of investigation results, surveys, and information collection at the commune and provincial levels; analyze and evaluate the results of implementing the current land price list for the construction of land price lists by region and location.
In addition, it is necessary to synthesize the results of investigation, survey, information collection; establish value zones; select standard land plots and determine prices for standard land plots; create a comparison ratio table for building land price tables for each land plot based on value zones and standard land plots.
From there, build a draft land price list and a draft explanatory report on building the land price list. This is also a step that many grassroots levels are interested in.
The next step when developing the first land price list at the provincial level is that the competent land management agency performs a number of tasks such as: developing a draft Proposal on the issuance of the land price list; posting a dossier to collect comments on the draft land price list on the electronic information page of the Provincial People's Committee and the competent land management agency within 30 days; collecting written comments on the draft land price list; receiving and completing the draft Proposal on the issuance of the land price list; directing the reception and explanation of comments, completing the draft land price list and the Explanatory Report on the development of the land price list.
Next, the competent land management agency submits the Land Price List Appraisal Council to the Land Price List Appraisal Council. After the Land Price List Appraisal Council conducts the appraisal of the land price list and sends the document of appraisal of the land price list to the competent land management agency, the next step is for the land management agency to receive, edit, and submit to the Provincial People's Committee for submission to the Provincial People's Council for decision.
The Provincial People's Council decides on the land price list, which is the 13th step. Next, the competent land management agency publicly announces and directs updating to the national land database. Step 15 is that within 15 days from the date of decision, the Provincial People's Committee sends the results to the Ministry of Agriculture and Environment .
The final step is that if necessary, the Provincial People's Council decides to adjust, amend, or supplement the land price list during the year, the Provincial People's Council decides to apply some or all of it according to the procedures prescribed in Decree No. 151/2025/ND-CP of the Government on the decentralization of authority of two-level local authorities, decentralization, and decentralization in the land sector.
In addition to the 16 steps to build the first land price list at the provincial level, according to the guidance of the Ministry of Agriculture and Environment, the commune level carries out 3 new internal procedures on land recovery.
Accordingly, 3 new procedures are implemented at the commune level, including: Land recovery for households, individuals, and residential communities in cases of land law violations as prescribed in Article 81 of the Land Law; Land recovery due to termination of land use according to the law, voluntary return of land, risk of threat to human life, no longer able to continue use according to Clauses 1, 2 and 3, Article 82 of the Land Law; Land recovery for cases prescribed in Clause 1, Article 48 of the Land Law.
The provincial level also implements a new procedure of land recovery from domestic organizations, religious organizations, affiliated religious organizations, people of Vietnamese origin residing abroad, foreign organizations with diplomatic functions, and economic organizations with foreign investment capital in cases of land law violations.
