"Privilege" of retirement health insurance for meritorious people

At the exchange program with Vietnam Social Security (VSS), Mr. Ngoan questioned the case of meritorious people who are receiving pension benefits.

According to regulations, meritorious people and retirees are entitled to free health insurance.

However, Mr. Ngoan wondered why the health insurance card for retirees was not issued to those with meritorious services but instead was issued to retirees.

Mr. Ngoan said that with the health insurance card for meritorious people, patients will be given priority for medical examination and treatment rather than using the health insurance card for retirees.

Specifically, in his case, he is both a beneficiary of the health insurance for meritorious people (card code KC2) and a beneficiary of the retirement health insurance (card code HT3). However, when he reaches the age to enjoy both regimes, he will be issued a retirement health insurance card (card code HT2).

According to Vietnam Social Security, the issuance of health insurance cards to people who simultaneously belong to many different health insurance participants is clearly regulated in Point 2, Clause 7 and Clause 15, Article 1 of Law No. 46/2014/QH13 amending and supplementing a number of articles of the Law on Health Insurance.

Based on the above provisions, in case a person simultaneously belongs to many different health insurance participants, he/she shall pay health insurance according to the first subject that he/she is determined according to the order of subjects specified in Article 12 of this Law.

At the same time, in case a person belongs to many health insurance participants, he/she will enjoy health insurance benefits according to the subject with the highest benefits.

According to Vietnam Social Security, based on the order of health insurance payment, Mr. Ngoan is both a participant in the resistance war and national defense (subject code KC, paid by the state budget) and a pensioner (subject code HT, paid by the social security organization), so he should pay health insurance according to the pensioner (subject code HT).

At the same time, he is entitled to a higher level of health insurance benefits for those participating in the resistance war to protect the fatherland (benefit code 2) instead of benefit code 3 of the retirement health insurance card, so being issued an HT2 card is in accordance with current law.
