List of 44 establishments required to purchase compulsory fire and explosion insurance

Decree No. 105/2025/ND-CP details a number of articles and measures to implement the Law on Fire Prevention, Fire Fighting and Rescue, which specifically stipulates the list of establishments required to purchase compulsory fire and explosion insurance.

44 establishments must purchase compulsory fire and explosion insurance

According to the Decree, the list of establishments required to purchase compulsory fire and explosion insurance specified in Appendix VII includes 44 establishments:

1. Apartment buildings and collective housing with buildings 5 ​​floors or higher or total floor area of ​​1,000 m² or more.

2. Nursery schools, kindergartens, preschools with 50 children or more or total floor area of ​​500 m2 or more.

3. Primary schools, junior high schools, high schools, multi-level general schools, universities, colleges, professional secondary schools, vocational schools, technical workers' schools, othereducational institutions as prescribed by law on education, space research facilities, specialized database centers and other specialized research facilities with buildings of 3 or more floors or with a total floor area of ​​1,500 m² or more.

4. Hospital.

5. Clinics (general or specialized), medical stations, maternity homes, disease prevention facilities, medical research and testing facilities, nursing homes, rehabilitation, orthopedic, nursing homes and other medical facilities under the Law on Medical Examination and Treatment with buildings of 3 or more floors or with a total floor area of ​​300 m² or more.

6. Stadium has a grandstand capacity of 2,000 seats or more.

7. Gymnasiums, sports training facilities, swimming pools, sports fields with stands, racetracks, shooting ranges, and other sports facilities established under the Law on Physical Education and Sports with 1,000 seats or more or a total floor area of ​​1,000 m² or more.

8. Theater, cinema, circus.

9. Conference centers, museums, libraries, exhibition halls, and galleries with buildings of 3 or more floors or a total floor area of ​​500 m² or more.

10. Aquariums, karaoke service businesses, dance halls, entertainment service businesses, performing arts facilities, and other cultural activities with 2 or more floors or a total floor area of ​​300 m2 or more.

11. Markets, shopping malls, supermarkets with a total floor area of ​​300 m² or more.

12. Food service establishments and other service establishments as prescribed by law with a total floor area of ​​300 m² or more.

13. Business establishments selling flammable goods with a total floor area of ​​200 m² or more.

14. Business establishments trading in flammable goods or non-flammable goods contained in flammable packaging with a total floor area of ​​1,000 m² or more.

15. Gas business establishments with total gas storage of over 500 kg.

16. Gas station.

17. Hotels, guesthouses, motels, resorts, and other accommodation service establishments with 3 or more floors or a total floor area of ​​500 m² or more.

18. Post offices, post offices, and other postal and telecommunications service providers with 3 or more floors or a total floor area of ​​500 m² or more.

19. Headquarters of state agencies, headquarters and offices of enterprises, political and social organizations with buildings of 3 or more floors or with a total floor area of ​​500 m² or more.

20. Multi-purpose houses, mixed-use houses, except houses combined with production and business with buildings of 3 floors or more or with a total floor area of ​​500 m² or more.

21. Oil refinery; petrochemical plant; refinery, petrochemical plant; gas processing plant; biofuel production plant; petroleum and petroleum product storage; liquefied gas storage; liquefied gas filling station; gas distribution station.

22. Power plant.

23. Transformer station with voltage from 110 kV or higher.

24. Facilities for manufacturing explosives, industrial explosive precursors, weapons, and support tools; fixed warehouses for storing explosives, industrial explosive precursors, weapons, and support tools.

25. Industrial production facilities with production service buildings of fire and explosion hazard class A, B.

26. Industrial production facilities with production service buildings of fire hazard class C.

27. Industrial production facilities with production service buildings of fire hazard class D, E with a volume of 5,000 m3 or more or have a total floor area of ​​1,000 m² or more.

28. Warehouses storing goods with fire and explosion hazard levels A, B, C have a total floor area of ​​200 m2 or more.

29. National reserve.

30. Warehouses for storing goods with fire hazard class D, E with a volume of 5,000 m3 or more or a total floor area of ​​1,000 m² or more.

31. Car and motorbike garages, car and motorbike showrooms with a total floor area of ​​500 m² or more.

32. Water plant, waste treatment plant.

33. Passenger terminal, diplomatic guest house, cargo terminal at airport; aircraft technical building; air traffic control tower.

34. Inland waterway ports and wharves; seaports belonging to construction works of level III or higher according to the provisions of law on construction.

35. Dry port.

36. Type II fishing port.

37. Bus stations, vehicle inspection centers, and rest stops with a total floor area of ​​500 m² or more.

38. Passenger stations, freight stations, railway depots, cable car stations, passenger stations, urban railway depots with a total floor area of ​​300 m² or more.

39. Road tunnels, railway tunnels, urban railway tunnels with length of 500 m or more.

40. Road motor vehicle repair and maintenance facilities with a total floor area of ​​500 m² or more.

41. Inland waterway vehicle and ship repair facilities with a total floor area of ​​1,000 m² or more.

42. Nuclear facilities.

43. Social assistance facilities have buildings of 3 or more floors or a total floor area of ​​300 m² or more.

44. Housing combined with production and business has a total area for production and business of 200 m2 or more.

Encourage other establishments to purchase compulsory fire and explosion insurance.

Decree 105/2025/ND-CP stipulates that establishments in the above list must purchase compulsory fire and explosion insurance for their assets, except for establishments under the management of the Ministry of National Defense and the Ministry of Public Security serving military, defense, security and order purposes. Other establishments are encouraged to purchase compulsory fire and explosion insurance.

For establishments with assets in the list of state secrets, special assets, specialized assets, and assets serving state management, insurance providers must ensure requirements on security, safety, and confidentiality in the process of providing compulsory fire and explosion insurance services.

Decree 105/2025/ND-CP also stipulates: The deduction level from insurance enterprises implementing compulsory fire and explosion insurance in the fiscal year is 2% of the total actual compulsory fire and explosion insurance premiums collected from original insurance contracts in the previous fiscal year.

The management of revenue from compulsory fire and explosion insurance shall comply with the provisions of Decree No. 67/2023/ND-CP dated September 6, 2023 of the Government regulating compulsory civil liability insurance of motor vehicle owners, compulsory fire and explosion insurance, compulsory insurance in construction investment activities and relevant legal provisions.

Revenue from compulsory fire and explosion insurance is used for fire prevention, fire fighting, rescue and relief activities as follows:

a- Expenses to support the purchase of fire prevention, fire fighting, rescue and salvage equipment for the Fire Prevention, Fire Fighting and Rescue Police Force: not exceeding 65% of the actual amount collected from compulsory fire and explosion insurance of insurance companies in the fiscal year. The purchase of fire prevention, fire fighting, rescue and salvage equipment shall be carried out in accordance with the provisions of the law on bidding;

b- Expenses for supporting propaganda, dissemination, education of knowledge and laws on fire prevention, fire fighting, rescue, and compulsory fire and explosion insurance: not exceeding 15% of the actual amount collected from compulsory fire and explosion insurance of insurance companies in the fiscal year. The content and level of expenditures for propaganda, dissemination, education of knowledge and laws on fire prevention, fire fighting, rescue, and salvage shall comply with the provisions of law on management, use and settlement of funds to ensure the dissemination and education of laws;

c- Expenditures to support the Fire Prevention, Fire Fighting and Rescue Police force in training, professional development, propaganda, inspection of fire prevention, fire fighting, investigation, handling of fire incidents, training in fire fighting, rescue; inspection and supervision of participation in compulsory fire and explosion insurance of establishments: not exceeding 15% of the actual amount collected from compulsory fire and explosion insurance of insurance companies in the fiscal year. Expenditure contents and levels are implemented according to the current financial expenditure regime;

d- Expenses to support and reward the achievements of organizations and individuals directly participating and coordinating in fire prevention, fire fighting, rescue and relief work: not exceeding 5% of the actual amount collected from compulsory fire and explosion insurance of insurance companies in the fiscal year.

This Decree comes into force from July 1, 2025.
