According to the official dispatch sent to the Government Office regarding the time to submit the Decree regulating the minimum wage for employees working under labor contracts, the Ministry of Labor, Invalids and Social Affairs said that this agency is assigned to develop a Decree regulating the minimum wage for employees working under labor contracts to submit to the Government in October 2023.
However, according to Article 91 of the Labor Code, the Government regulates and promulgates the minimum wage based on the recommendations of the National Wage Council.
The minimum wage is adjusted based on the minimum living standards of workers and their families; the correlation between the minimum wage and market wages; the consumer price index, the growth rate of the economy ; the relationship between supply and demand; employment and unemployment; and the solvency of enterprises.
In fact, the economy in the second quarter and the first months of the third quarter have shown signs of improvement.

At the end of August, the National Wage Council reported to the Government on the consideration of the minimum wage plan applicable for 2024.
It clearly states that the impacts and forecasts of the socio-economic situation in the coming time have not been fully assessed; there is not enough scientific and practical basis to propose the time to adjust the regional minimum wage.
Therefore, the Council agreed to report to the Government to allow the negotiation meeting to be postponed, and to make recommendations to the Government on the regional minimum wage plan to be postponed until the end of the fourth quarter of 2023.
The Ministry of Labor, Invalids and Social Affairs requested the Government Office to report to the Prime Minister to remove the content of submitting a Decree regulating regional minimum wages for workers from the Ministry's 2023 work program.
The drafting of the above Decree will be carried out after the National Wage Council recommends to the Government on the 2024 minimum wage plan.
Previously, the Government Office sent an official dispatch to the Minister of Labor, War Invalids and Social Affairs and the National Wage Council regarding the time to report on the minimum wage plan for 2024.
The Ministry of Labor, War Invalids and Social Affairs is assigned to study the report of the National Wage Council in the process of performing the assigned state management functions and tasks according to regulations. In case of exceeding authority, the report must be submitted to the competent authority before September 30.
At the regular Government meeting in August, the Government requested the Ministry of Labor, War Invalids and Social Affairs to focus on implementing social security policies; propose increasing the minimum wage for workers and laborers, and report to competent authorities.
In early August, the National Wage Council held its first meeting to discuss adjusting the regional minimum wage in 2024.
At the end of the first meeting on the morning of August 9, the National Wage Council agreed to hold the next meetings in the fourth quarter of 2023 instead of in July and August as usual.
At the meeting, representatives of employees, employers... presented the basis and proposed level of increase in regional minimum wage in 2024. Basically, all members shared the difficulties of businesses, shared the lives of workers, laborers, and incomes that do not guarantee a minimum standard of living.
The technical department proposes a salary increase from 1/1/2024 or 1/7/2024. The proposed salary increase level follows the principle that the minimum wage is equal to or higher than the minimum living standard.
The union wants the minimum wage adjustment in 2024 to increase by 5-6%.
