Proposal to amend regulations on motor vehicle modification

The Ministry of Transport is drafting a Circular amending Circular 85/2014/TT-BGTVT regulating the renovation of road motor vehicles, including proposing to amend many regulations on the renovation of motor vehicles.

Proposal to amend some regulations on motor vehicle modification

Specifically, it is proposed to amend and supplement the title and content of the opening section of Article 4; amend and supplement Clause 1, Clause 3, Clause 8, Clause 16, Clause 20, Clause 21, Clause 23, Article 4 of Circular 85/2014/TT-BGTVT as follows:

- Amend and supplement the title and content of the opening section of Article 4 as follows:

Article 4. General provisions

The conversion of motor vehicles and motor vehicles after conversion must comply with the technical safety and environmental protection requirements specified in Appendix XI, relevant standards and regulations and meet the following provisions:”.

- Amend some regulations on motor vehicle modification:

+ Do not renovate or change the function (purpose of use) of motor vehicles that have been around for more than 15 years from the year of manufacture to the year of design appraisal.

(Currently, Circular 85/2014/TT-BGTVT stipulates: No modification or change of purpose of use (use) for motor vehicles that have been used for more than 15 years, from the year of manufacture of the motor vehicle to the time of design appraisal)

+ Do not modify the truck body of newly imported, manufactured, assembled, and unused trucks within 06 months from the date of issuance of the first Inspection Certificate and Inspection Stamp until design appraisal (except for the case of modification into a driver training vehicle; modification and installation of additional covers for open-body trucks).

(Currently: Do not modify the truck body of newly imported, manufactured, assembled, and unused trucks within 06 months from the date of the first technical safety and environmental protection inspection to the design appraisal (except for the case of modification into a driving practice or testing vehicle; modification and installation of additional covers for open-body trucks))

+ Do not modify or install double-decker sleeper beds on passenger vehicles, except in cases where the original vehicle is converted into a passenger vehicle with sleeper beds.

(Current: No renovation or installation of double-decker beds on passenger vehicles)

+ The total weight allowed to participate in traffic of a motor vehicle after conversion must not exceed the total weight value according to the original vehicle's design and regulations on road and bridge loads.

(Currently: The total mass allowed to participate in traffic of motor vehicles after renovation must ensure:

++ For passenger vehicles: Not greater than the smaller value of the total designed weight corresponding to the maximum number of people allowed to be carried according to the manufacturer's design and the total weight allowed to participate in traffic according to regulations on road and bridge loads.

++ For trucks and specialized vehicles: Not greater than the value of the total mass according to the manufacturer's design and the total mass allowed to participate in traffic according to regulations on road and bridge loads.)

+ Cranes and lifting equipment when installed on converted motor vehicles must be certified and inspected for technical safety of lifting equipment according to regulations; Tanks carrying dangerous goods, tanks carrying liquefied gas, and pressure tanks when installed on converted motor vehicles must be certified and inspected for safety of pressure equipment according to regulations.

(Currently: Cranes, tankers carrying dangerous goods, tankers carrying compressed gas, liquefied gas when newly installed on converted motor vehicles must be inspected and certified by a competent authority for features, quality, and technical safety)

+ During use, motor vehicles are only modified or changed in one of the two main components: the engine or the frame.

(During the entire period of use, each motor vehicle can only be modified or changed in one of the two main assemblies, the engine or frame, and cannot be modified in more than three of the following systems or assemblies: cockpit, body or trunk, passenger compartment; transmission; motion; suspension; brakes; steering; fuel)

+ In case a motor vehicle is modified to ensure that it can be driven by a person with disabilities but the modified content is not in accordance with the provisions of Article 4 of Circular 85/2014/TT-BGTVT, the modification can still be carried out. A motor vehicle that has been converted into a motor vehicle for a person with disabilities to drive can only be converted back to the original vehicle.

(Currently: In case a motor vehicle is modified to ensure access for people with disabilities, but the modified content is not in accordance with the provisions of Article 4 of Circular 85/2014/TT-BGTVT, the modification can still be carried out. A motor vehicle that has been modified to be a motor vehicle for people with disabilities can only be converted back to the original vehicle)
