Proposal for food supplements to register product declaration

The Ministry of Health is seeking opinions from functional units on the draft Decree amending and supplementing Decree No. 15/2018/ND-CP (Decree 15) of the Government detailing the implementation of a number of articles of the Law on Food Safety (FSS).

According to the Ministry of Health , Decree 15 currently stipulates that businesses have the right to self-declare and take full responsibility for food products; management agencies only conduct very limited post-inspection. This leads to many cases where businesses arbitrarily classify products, exaggerate their uses, but they are still allowed to circulate.

Therefore, in the draft Decree amending and supplementing Decree 15, the Ministry of Health proposed that the agency receiving the self-declaration dossier must provide comments, publicly post, develop a post-inspection plan and conduct monitoring sampling if violations are detected. This regulation is expected to help better control the quality and transparency of the product from the beginning.

Along with that, the draft amended Decree also clearly stipulates the responsibilities and tasks of the agency receiving self-declaration dossiers and implementing the plan for post-auditing dossiers. In fact, Decree 15 is classifying food supplements into the group of pre-packaged processed foods and allowing businesses to self-declare, without requiring product declaration registration.

This is a loophole that many businesses take advantage of, falsely declaring product groups or turning health protection foods into dietary supplements to avoid advertising inspection. Therefore, in the draft revised and supplemented decree, the Ministry of Health proposed to clearly stipulate that dietary supplements must register a product declaration before being circulated, and must also have their advertising content and uses controlled to prevent misleading information for consumers.

* The Hanoi People's Committee has just issued a plan to ensure food safety during the peak period to serve the activities to celebrate the 80th anniversary of the successful August Revolution (August 19, 1945 - August 19, 2025) and the National Day of the Socialist Republic of Vietnam (September 2, 1945 - September 2, 2025), welcoming the 18th Congress of the Hanoi Party Committee, term 2025-2030.

The peak inspection period is from July 2025 to September 2025 throughout the city, focusing on locations where celebrations, parades, and marches are held. The implementation contents include: reviewing production, business, processing, food service, and street food establishments; inspecting and handling violations, and penalizing establishments that do not ensure food safety conditions; inspecting sponsored food, testing safety indicators; preparing plans to handle food poisoning; establishing a rapid response team, ready to investigate, provide emergency care, etc.
