According to the draft regulations, the type of construction built on agricultural land is construction serving agricultural production, including: rest houses, sheds, camps to serve workers; construction for preserving agricultural products, storing pesticides, fertilizers, machinery, tools and other auxiliary constructions.
Construction works directly serving agricultural production can only be built with 1 floor, no basement. Construction works directly serving agricultural production can be built in many locations on the land, but the total area must not exceed the limit prescribed by the province. The land area for construction works mentioned above does not have to change the land use purpose and is still counted as agricultural land.
Dong Nai Provincial People's Committee stipulates that the area of construction works depends on the land area. Specifically, for land with an area of 0.5 ha to less than 5 ha, the total land area for construction works must not exceed 50m2 .
For land from 5 hectares to less than 10 hectares, the total land area for construction works must not exceed 100m2 .
Land area from 10 ha to less than 20 ha, land area used for construction works not exceeding 200m2 .
Land area from 20 hectares or more, the maximum construction area ratio is 0.001% of the total agricultural land area but does not exceed 500m2 .
This is a regulation to strictly manage land use, ensuring that agricultural land is used for the right purpose. At the same time, it creates conditions for people to build works to serve agricultural production without having to change the purpose of land use.
