It is expected that the Chairman of the People's Committee at the commune level has the authority to issue an order calling citizens to register for military service for the first time.

On May 13, Deputy Minister of Justice Dang Hoang Oanh chaired a meeting of the Council for Appraisal of the draft Law amending and supplementing the Law on National Defense; Law on Officers of the Vietnam People's Army; Law on Professional Soldiers, Workers and Civil Servants of National Defense; Law on Military Service; Law on Vietnam Border Guard; Law on People's Air Defense; Law on Reserve Forces; Law on Civil Defense; Law on Management and Protection of National Defense Works and Military Zones; Law on Militia and Self-Defense Forces; Law on National Defense and Security Education (amending and supplementing 11 laws).

Reporting at the Council, Colonel Nguyen Viet Dung, Director of the Legal Department, Ministry of National Defense , said that this draft law aims to promptly and fully institutionalize the policies and orientations in the Party's documents and resolutions, conclusions of the Politburo, Secretariat, provisions of the Constitution, and the Law on Organization of Local Government (amended) related to the arrangement and reorganization of administrative units at all levels.

In particular, the Law on National Defense was amended and supplemented with 3 articles on authority related to defense zones, martial law, curfew, etc. The Law on Professional Soldiers, Workers and National Defense Officials was amended with content on the release of reserve professional soldiers.

Colonel Nguyen Viet Dung, Director of the Legal Department, Ministry of National Defense, reported on the draft law.

The Law on Military Service is amended with content related to the arrangement of the political system's apparatus regarding the organization of local governments at two levels (commune and provincial levels). Accordingly, the authority to decide on recognition of regular militiamen who have completed their military service (NVQS) in peacetime from the commander of the district-level military command (CHQS) to the commander of the provincial-level military command is transferred; the authority to issue orders to call citizens to register for military service for the first time and remove them from the list of military service from the commander of the district-level military command is transferred to the chairman of the commune-level People's Committee.

This Law also supplements the authority of the Chairman of the Provincial People's Committee to decide to establish regional health examination councils upon the request of the Department of Health; to decide on the list of citizens to enlist and perform the obligation to join the People's Public Security; to decide to postpone or exempt conscription; to supplement the authority of the Chairman of the Commune People's Committee to issue an order to call each citizen to enlist and perform the obligation to join the People's Public Security...

Opinions at the meeting suggested that the drafting committee closely follow the Prime Minister's instructions, ensuring "6 clear", including: clear content of amendments, which content is added, which content is removed; focus on 3 issues related to decentralization; clearly explain the issue of staffing... Regarding administrative procedures, it is necessary to clearly explain how many procedures are reduced, how much time is reduced to handle those administrative procedures; at the same time, strictly implement regulations related to protecting state secrets...

Concluding the review session, Deputy Minister of Justice Dang Hoang Oanh requested the drafting agency to continue reviewing and clearly defining the responsibilities and authorities of ministries and branches to avoid overlap and inadequacies; and carefully assess the impact of arising administrative procedures.
