Assigning provincial level to perform 7 tasks under the authority of the Minister of Education and Training

The Ministry of Education and Training has just announced a draft on decentralization and delegation of power in the education sector, in which it assigns 7 tasks under the authority of the Minister of Education and Training to the provincial level.

The provincial People's Committee will be decentralized to perform 7 tasks under the authority of the Minister of Education and Training , and the commune People's Committee Chairman will also be assigned two new tasks.

This is a notable point in the draft Circular guiding the functions, tasks, and powers of the Department of Education and Training under the People's Committee of the province and centrally-run city and the field of education and training of the specialized departments under the People's Committee of the commune, ward, and special zone of the province and centrally-run city. The draft has just been published by the Ministry of Education and Training on its electronic information portal to collect comments.

Compared with the current document, this draft has many notable adjustments.

Specifically, the draft expands the authority and scope of management of the Department of Education and Training. Accordingly, the Department of Education and Training is assigned to advise the provincial People's Committee to perform 7 tasks under the authority of the Minister of Education and Training, now delegated to the Chairman of the provincial People's Committee according to Decree 143/2025/ND-CP.

Duties include:

- Recognize the province as meeting the standards of universal education level 1 and level 2, eliminating illiteracy level 1 for the province.

- Permit the establishment of preschool and general education facilities by foreign diplomatic missions and intergovernmental international organizations.

- Converting preschool and general education facilities proposed to be established by foreign diplomatic missions and intergovernmental international organizations into non-profit facilities.

- Approval of joint organization of foreign language proficiency certification exams.

- Granting, extending, amending and supplementing decisions permitting the establishment of representative offices of foreign educational organizations and institutions in Vietnam.

- Grant, amend, supplement, extend, re-grant, terminate operations, and revoke licenses to establish representative offices of foreign vocational education organizations and institutions in Vietnam.

- Assess the conditions for organizing teaching of ethnic minority languages.

The Department of Education and Training is assigned to carry out all recruitment, management, use, reception, mobilization, secondment, transfer, appointment, promotion of professional titles, change of professional titles, training, fostering, and evaluation of the team of teachers, management staff, civil servants, and employees in all public educational institutions in the province according to the provisions of Decree No. 142/2025/ND-CP. Previously, for preschool, primary, and secondary schools, these tasks were performed by the district-level People's Committees and the Department of Education and Training.

At the commune level, the draft circular also specifically stipulates the advisory role of the specialized department on education and training under the commune-level cultural and social department in performing state management tasks on education for educational institutions in the area.

In particular, the draft has added two new tasks, which were not previously assigned to the chairman of the commune-level People's Committee.

Specifically, the chairman of the commune-level People's Committee decides to recognize, appoint, reappoint, extend the working period to retirement age, dismiss, remove from office, second, change job positions, reward and discipline the heads and deputy heads of public educational institutions under their management.

The Chairman of the People's Committee at the commune level decides to establish the school council; recognize, appoint, and dismiss the chairman of the school council; add or replace members of the school council at public educational institutions; decide to recognize or not recognize the school council, chairman, vice chairman of the school council, principal, and vice principal at private educational institutions in accordance with the title standards and legal procedures.

According to the Ministry of Education and Training, clearly defining the scope of consultation and limits of authority at the commune level is a necessary step to perfect the decentralization mechanism in education management, contributing to improving the effectiveness and efficiency of policy implementation at the grassroots level.

The Ministry of Education and Training said the draft was developed to specify the provisions in Decree No. 142/2025/ND-CP regulating the decentralization of authority of two-level local authorities in the field of state management of the Ministry of Education and Training and Decree No. 143/2025/ND-CP regulating the decentralization of authority and decentralization in the field of state management of the Ministry of Education and Training.
