Untie institutional "bottlenecks"

On May 29, 2025, at the 9th Session, the 15th National Assembly officially passed Resolution 201/2025/QH15 on piloting a number of specific mechanisms and policies for social housing development. This is considered an important breakthrough, demonstrating the determination of the Party and State in solving the problem of social security.

The resolution not only has profound humanistic significance, but is also expected to create a big push, removing long-standing "bottlenecks" in administrative mechanisms and procedures, helping to reduce the burden on investors and speed up the progress of social housing projects across the country.

“SPECIAL MEDICINE”

Resolution 201/2025/QH15 is an important legal document, regulating the pilot implementation of many specific mechanisms and policies to promote social housing development nationwide for 5 years (from June 1, 2025 to June 1, 2030).

Resolution 201/2025/QH15 opens a new legal framework, allowing for piloting specific mechanisms and policies to promote social housing development nationwide. The scope of regulation includes the establishment of the National Housing Fund, assigning investors without bidding, to investment procedures, determining selling prices, rental prices and housing support conditions. This marks the flexibility and determination of the National Assembly in solving the housing problem - an essential need but still facing many challenges in Vietnam.

Economic experts believe that Resolution 201/2025/QH15 is truly a “special remedy” for the problems that have hindered the development of social housing for many years. The specific regulations have focused on solving the biggest “bottlenecks” in terms of mechanisms and procedures, helping to significantly reduce the administrative and financial burden for investors.

Previously, the selection of social housing investors often had to be done through bidding or auctioning of land use rights, or had to be done in parallel with separate procedures between approving the investment policy and selecting investors. This process was very time-consuming, costly and potentially risky for investors due to the complexity of legal procedures.

Article 1.1b and Article 5 of the Resolution allow for the assignment of investors, approval of investment policies, and at the same time the assignment of investors without bidding or auction for social housing projects that do not use public investment capital and use land funds allocated or leased by the State.

This regulation significantly reduces the time and costs associated with land procedures and investor selection. Investors can quickly start implementing projects after approval, eliminating the risk of competition in bidding and auction while still ensuring publicity and transparency through criteria for selecting capacity. This is especially attractive to businesses with experience and financial potential in the construction sector.

In addition, the exemption of land use fees and land rent (Article 8) is considered one of the biggest incentives. Before this Resolution, although there was a policy of exemption and reduction of land use fees, the determination of the exemption and reduction levels and implementation procedures were still complicated, sometimes causing delays. The regulation of exemption of all land use fees and land rent for social housing projects helps to directly reduce the initial investment costs of the project, thereby reducing the cost of social housing and increasing accessibility for home buyers.

This incentive directly addresses the biggest financial burden for investors - land costs. When land costs are reduced or zero, the cost of social housing products will be lower and more accessible to beneficiaries. This not only encourages investors to participate, but also helps the social housing market become more vibrant.

Cumbersome and time-consuming administrative procedures have been a problem for many years. By simplifying investment procedures (Article 7, Clauses 2 and 3, Article 8, Clauses 1, 2, 6, 7, Article 12), the Resolution has boldly cut down on intermediary steps, shortened the time for approving documents, approving investments, and granting construction permits.

Although the Resolution does not detail each specific procedure that will be cut, the emphasis on “piloting a number of specific mechanisms and policies” and setting early implementation dates (from June 1, 2025 and July 1, 2025 for some articles) shows the National Assembly’s determination to streamline the process. Overlapping and cumbersome administrative procedures are one of the biggest barriers to all investment projects, especially social housing projects with low profit margins.

Simplifying procedures helps shorten project implementation time, reduce opportunity costs for investors; at the same time, help products reach people faster. This is a key factor to attract private investors to participate in the social housing segment.

CREATING THE MOST FACILITIES FOR SOCIAL HOUSING PROJECTS

The establishment of the National Housing Fund (Article 4) is considered by experts to be an important decision to create a legal framework, helping investors feel more secure about their ability to access preferential loans. In the context of rapid urbanization and population growth in key economic areas, the need for housing, especially social housing, is becoming increasingly urgent.

The Resolution provides legal tools to mobilize resources from both the State and the private sector, through the National Housing Fund - a non-budgetary, non-profit state financial fund. This source of capital is formed from the budget, proceeds from the sale of public assets, proceeds from land use rights auctions and voluntary support sources.

Diversified capital sources and clear targets on capital support and interest rates for both investors and homebuyers have created a stronger and more sustainable financial tool. Previously, capital for social housing mainly relied on the state budget and some preferential credit packages from banks.

The establishment of the fund provides a more stable and long-term source of capital, reduces pressure on the budget and creates a proactive mechanism for funding projects, avoiding the situation of "broken" capital sources due to dependence on annual budget approval. This also helps investors feel more secure about their ability to access preferential loans.

In particular, recently, on July 3, 2025, the Government issued Decree 192/2025/ND-CP detailing and guiding the implementation of a number of articles of Resolution 201/2025/QH15 of the National Assembly on piloting a number of specific mechanisms and policies for social housing development.

This Decree plays a role in concretizing the breakthrough mechanisms and policies of the National Assembly, turning policies into clear legal corridors, creating the most favorable conditions for implementing social housing projects in practice.

Accordingly, the Decree provides detailed regulations on the National Housing Fund such as: Organizational structure and operation, capital sources and principles of use, support policies from the fund. At the same time, it provides detailed instructions on the mechanism for assigning investors without bidding; detailed preferential policies on tax and land; specific regulations on preferential credit; simplification of administrative procedures and processes...

In addition, the Decree also specifically regulates the inspection and supervision of the implementation of Decree 192/2025/ND-CP and Resolution 201/2025/QH15, ensuring that policies are implemented effectively, transparently and preventing negativity...

It can be said that Resolution No. 201/2025/QH15 is an important milestone in the social housing development policy in Vietnam, especially in the context of implementing the policy of merging provinces and cities. Decree 192/2025/ND-CP is a very important legal document, directly turning major policies on social housing into reality, an important step in perfecting the social housing institution, creating a strong driving force for the development of this housing segment, meeting the urgent needs of society.

With flexible mechanisms and specific support, the Resolution not only solves housing difficulties for officials, civil servants and workers, but also contributes to building a fair and civilized society. This is a testament to the National Assembly's determination to realize the goal of sustainable development, improve the quality of life and strengthen people's trust in the leadership of the Party and State in the new period.
