The Hanoi Party Committee has just issued Regulation No. 12-QD/TU on “Management of cadres, decentralization of cadre management and appointment and introduction of cadres for election” to specify the new regulations of the Central Committee; replacing the previous regulations of the Hanoi Party Committee on management of cadres, decentralization of cadre management and appointment and introduction of cadres for election and previous regulations contrary to this regulation.
Do not appoint, nominate, transfer, confer or promote military ranks on cadres and party members who are under disciplinary review or handling.
The newly issued regulations clearly state specific provisions on decentralization of cadre management; appointment and introduction of cadres for election; reappointment, introduction of re-election; transfer, secondment and transfer of work positions for cadres; dismissal, resignation and arrangement of cadres after dismissal or resignation.
Specifically, the newly issued regulations state the titles and positions under the management of the Standing Committee of the City Party Committee; the process of appointing and recommending candidates for positions under the management of the Standing Committee of the City Party Committee; the process of considering dismissal, resignation and arranging the positions of officials under the management of the Standing Committee of the City Party Committee after dismissal or resignation.
Pursuant to the resolution of the Standing Committee of the City Party Committee on personnel work, the Party Delegation of the City People's Council, the Party Executive Committee of the City People's Committee; the Party Delegation of the Fatherland Front, socio -political organizations, associations (with established Party Delegations) in the City; the Standing Committee of the Hanoi Youth Union; the standing collectives of organizations: the City Cooperative Union, the City Union of Friendship Organizations, the City Red Cross Society, the City Journalists Association lead and direct the implementation of the election or appointment of cadres to positions under the management of the Standing Committee of the City Party Committee in accordance with the provisions of law and the organization's charter.
Party committees, Party organizations, agencies, units and each cadre and Party member are responsible for organizing the serious and complete implementation of the decisions of the Standing Committee of the City Party Committee on cadres and cadre work. No collective or individual is allowed to change or fail to properly implement the decisions of the Standing Committee of the City Party Committee. In special cases where changes are required, they must be assessed, reported to the Organizing Committee of the City Party Committee and approved by the Standing Committee of the City Party Committee.
When changing, appointing or dismissing key leaders of city-level agencies managed by central ministries, departments and branches, the Standing Committee of the City Party Committee shall provide opinions for the Party Delegation, Party Executive Committee or leaders of central ministries, departments and branches to consider and decide. In case of different opinions, the Party Delegation, Party Executive Committee or leaders of central ministries, departments and branches shall decide and be responsible for their decisions.
Party committees, Party organizations and the collective leadership of competent agencies shall consider, decide on the appointment and nomination of candidates according to their authority; ensure the leadership of the Party, the principles of democratic centralism, objectivity, publicity and transparency, and fully promote the authority and responsibility of each member and leader. This must also ensure the stability, succession and continuous development of the staff; improve the quality and efficiency of work. Do not appoint, nominate candidates, transfer, confer or promote military ranks on cadres and Party members who are under consideration or disciplinary action.
Regarding "Standards and conditions for appointment and introduction of cadres to run for higher positions", in addition to ensuring general standards and title standards according to regulations, cadres appointed or introduced to run for higher positions must not violate regulations on what party members, cadres, civil servants, and public employees are not allowed to do.
This officer must also have held the current position or equivalent position for at least 2 years. Special cases will be considered and decided by the competent authority.
Disciplined officials shall not be assigned, appointed, or recommended for candidacy to a position higher than the position they were disciplined for within the following period of time (from the effective date of the disciplinary decision): 12 months for the disciplinary form of Reprimand; 30 months for the disciplinary form of Warning; 60 months for the disciplinary form of Removal from office.
At least 90 days before the expiration date of the appointment term, the head and collective leadership of the agency or unit directly employing the cadre must review, report and be responsible to the competent authority for requesting the policy of reappointment or extension of the term of office of leadership or management to retirement age for the cadre.
