Accordingly, the Resolution was issued to implement Clause 7, Article 21 of the 2024 Capital Law. The Resolution stipulates the authority to establish; the order and procedures for establishment; organization, operation, management measures and preferential policies for cultural industrial centers in Hanoi.
The Resolution clearly states that a cultural industry center is an organization invested in and established by a State agency, enterprise, organization, or individual, headquartered at a location with defined geographical boundaries to operate in the field of cultural industry, providing infrastructure services, support services for production and trading of cultural products, and developing a creative ecosystem.
These areas will be established in neighborhoods, streets, craft villages, and existing rural residential areas with advantages in terms of commercial location and cultural space. Priority will be given to arranging development areas in areas oriented to develop according to the TOD model (Transit Oriented Development - public transport-oriented urban areas) according to the provisions of the Capital Law.
The commercial and cultural development zone will operate on the principle of voluntariness and self-management; ensuring the consensus of the majority of representatives of production, business and service establishments, owners of houses/architectural works, and households residing in the zone.
Applying standards and conditions on business culture, security, order, food safety and hygiene, and environmental protection in commercial and cultural development areas higher than general regulations to develop cultural and creative activities associated with sustainable economic development, preserve and promote cultural values and traditional industries and professions, and attract and develop tourism in the area.
The State encourages and prioritizes investment in infrastructure development, protection and promotion of cultural heritage values, development of cultural industrial centers within commercial and cultural development zones; ensuring security, order, social safety, and improving landscape and environment.
The Resolution also allows for controlled testing of new innovative technologies, products, services or business models in cultural industries at cultural industry centers within a limited framework of space, time and objects to assess feasibility and impact before widespread application.
At the same time, the requirements for organization and operation of the establishment of a Cultural Industry Center must ensure the requirements for area for production and business activities; trade, ancillary services for cultural industry activities; organization of shared workspaces and other infrastructure to support creative startups, business incubation in the fields of cultural industry...
Have a plan to support artists, artisans, and cultural practitioners in creative activities, design, art performance, display of works, and production of cultural products; have a plan to protect and promote the value of cultural heritage within the cultural industrial center (if any); have a plan to commit to ensuring security, order, social safety, environmental protection, and promotion of cultural values.
The city also stipulates a number of preferential policies to support investment in the development of cultural industrial centers with the following contents: planning and arranging land funds; prioritizing capital allocation for investment in construction, renovation, repair, and upgrading of cultural industrial infrastructure; mobilizing resources to implement projects to develop cultural industrial centers for assignment, franchise, or lease. Prioritizing consideration of converting the purpose of use of public property works into new cultural creative spaces to develop cultural industrial centers...
Specifically, cultural industrial centers, enterprises, organizations and individuals producing and trading in cultural industrial centers enjoy preferential policies for new investment projects in cultural industries as prescribed in Point a, Clause 1 and Clause 2, Article 43 of the Law on the Capital.
Cultural industrial centers are considered for exemption or reduction of land and water surface rent according to regulations in Clause 2, Article 43 of the 2024 Capital Law or exemption of land rent according to regulations of law on policies to encourage socialization.
In case of renting public property to establish a cultural industrial center according to the provisions of this Resolution, investors are considered to deduct land rent according to the provisions of law from the construction rent in case the construction rent includes land rent; are exempted from construction rent for a maximum period of 3 years in the first year of establishment, and receive a 50% reduction in construction rent for a maximum period of 3 subsequent years.
Enterprises, organizations, and individuals producing, trading, and providing services in the cultural industrial center enjoy incentives and financial support to participate in the city's investment, trade, and tourism promotion programs; support for promotion and communication about the cultural industrial center, cultural products and services; support for training and fostering high-quality human resources in cultural industries; support for creative startups through sponsorship programs and business incubators implemented in accordance with the city's regulations...
