Therefore, social housing (NƠXH) becomes a safe and financially reasonable choice for families to "settle down".

In Thanh Hoa, in recent years, many social housing projects have been implemented with a large number of apartments, meeting market demand, contributing to the completion of the goal of the Government's Project "Investing in the construction of at least 1 million social housing apartments for low-income people and industrial park workers in the period of 2021-2030". According to information from the Department of Construction, up to now, 13 projects have been and are being built in the province, with a total of 12,248 apartments (1 completed project, 12 projects in progress); 14 projects are completing investment procedures, expected to build about 7,596 apartments.

Social housing projects are under construction with a large number of apartments, diverse in many segments, making the social housing market in the province more vibrant. In the face of high demand, in some social housing projects under construction, depositing to hold a place has become quite common. Some people working in the real estate industry also use tricks to urge customers to deposit to hold a place and collect the difference. According to Mr. Le H.D., from Thuong Xuan district, currently working in Thanh Hoa city, he wants to buy a social housing unit in a project being implemented in the city. This building has not yet completed the foundation, but when he asked to submit a purchase application, the investor informed him that it was out of stock. However, information about apartments and deposits for "house purchases" is widely advertised by "land brokers" on social networks and they demand a difference of tens of millions of dong, even hundreds of millions of dong, making people in need of housing like him really upset when prices are "inflated".

Discussing the contents related to the subjects of social housing purchase, related rights and responsibilities, lawyer Vu Van Tra, Son Tra Law Company Limited, Thanh Hoa Provincial Bar Association, said: Currently, according to the provisions of Chapter VI, Housing Law 2023 and Article 29 of Decree 100/2024/ND-CP of the Government detailing a number of articles of the Housing Law on the development and management of social housing, people can buy social housing when they meet the conditions of being eligible for social housing support policies; meeting the conditions of housing and income.

Regarding the subjects eligible for social housing support policies, Article 76 of the 2023 Housing Law stipulates 12 groups of subjects. Regarding the conditions, people who can buy social housing must meet the following housing requirements: They must not have their own house in the province or centrally-run city where the social housing construction investment project is located; they must not have purchased social housing; they must not have enjoyed housing support policies in any form in the province or city where the social housing construction investment project is located.

Own a house in a social housing project area but the average housing area per capita is lower than the minimum housing area (less than 15m2 of floor space/person). The average housing area per capita is determined based on the following: the applicant, his/her spouse, father, mother (if any) and children (if any) who are registered as permanent residents in that house. In the case of civil servants, public employees, or armed forces members, they are not currently living in official housing.

Regarding income conditions, for low-income earners in urban areas; workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial zones; cadres, civil servants, and public employees, the following income conditions must be met: In case the applicant is single, the actual monthly income must not exceed 15 million VND (calculated according to the wage and salary table confirmed by the agency, unit, or enterprise where the applicant works); in case the applicant is married, the applicant and his/her spouse must have a total actual monthly income of not more than 30 million VND (calculated according to the wage and salary table confirmed by the agency, unit, or enterprise where the applicant works). The time to determine income conditions is within 1 consecutive year, calculated from the time the applicant submits a valid application to the investor to register to buy social housing.

In the case of low-income people in urban areas without labor contracts, within 7 days from the date of receiving the request for confirmation, the People's Committee at the commune level shall confirm the income conditions for 1 consecutive year from the time of submitting valid documents to the investor to register to buy social housing.

For poor and near-poor households in rural areas; poor and near-poor households in rural areas in areas frequently affected by natural disasters and climate change; poor and near-poor households in urban areas, they must be poor and near-poor households according to the Government's poverty standards.

For officers, professional soldiers, non-commissioned officers of the People's Armed Forces, workers, civil servants, defense workers and public employees currently serving in the army; people working in cryptography, people working in other positions in cryptography organizations receiving salaries from the State budget, the income conditions prescribed in Article 67 of Decree 100/2024/ND-CP shall apply.

To effectively implement the provisions of the law on social housing, it is necessary to well implement the stages of providing and making transparent information about social housing projects; registration, receiving documents, reviewing subjects, signing apartment purchase contracts; enhancing the responsibility of the People's Committees of wards, communes and towns when confirming people's documents related to purchasing social housing; strictly implementing the "post-inspection" stage to ensure that only those with real housing needs can buy social housing. Only then will low-income people have more opportunities to access social housing policies.
