Effective dispute resolution

Deputy Director of the Department of Justice Nguyen Thanh Son said: Mediation is a key task contributing to ensuring political security and social order and safety in the locality, and the team of mediators is the frontline force in resolving conflicts and small disputes among the people. In recent times, the Department of Justice has proactively and actively advised the Provincial People's Committee to deploy and implement the provisions of the Law on Mediation into practice, contributing to making mediation increasingly systematic and truly an effective method of resolving disputes within the community.

Mr. Le Trong Tri, a member of the Tay Thanh village mediation team, Quang Thanh commune (Quang Dien) said, I have been working in the mediation team for 10 years now. Every year I participate in legal knowledge training and professional training in mediation. In the training courses, we are promptly updated with new legal knowledge and instructions on how to handle real-life situations; thereby, the quality of mediation is improved. On average, each year, the mediation team handles 5-8 cases, many of which are difficult, related to land, boundaries between households, domestic violence, etc.

Deputy Head of the Justice Department of Quang Dien district, Ms. Phan Thi Minh Nguyen shared that the district currently has 95 mediation teams with 566 grassroots mediators (each team has 5-7 people). Over the past 10 years, the district has received mediation for 1,131 cases. With a firm grasp of legal knowledge and mediation skills, along with a sense of responsibility, the mediators have successfully mediated 903 cases. Mediation is mainly "settlement" rather than "trial". Disputes and conflicts causing small property damage; disputes on marriage and family; small, petty disputes, if not resolved early by the mediator team, will lead to major disputes over time. Therefore, the district's mediator team has promoted its role, promptly reconciling conflicts and disputes at the grassroots level.

Mr. Nguyen Tuan Anh, Vice Chairman of Quang Dien District People's Committee, said: To successfully mediate, the HGV team proactively studied legal documents, learned about the reality, met, encouraged, and persuaded households many times, applied the law, village sentiment, and sometimes invited commune and town officials to help. The mediation work not only contributes to building great solidarity among the people, but also supports the government to perform well and ensure good management of the State according to the provisions of the law. The district will continue to pay more attention to building the HGV team, selecting people with prestige and capacity in performing their tasks.

In order to effectively implement the Law on Civil Procedure, all levels and sectors have promoted the propaganda work on the Law on Civil Procedure in many forms such as: oral propaganda, mass media, loudspeakers, and dramatization. In addition, the work of fostering legal knowledge and professional skills in civil procedure has been regularly implemented by all levels and functional sectors; thereby, contributing to building a team of civil procedure experts with professional skills, legal knowledge and prestige, effectively implementing civil procedure work.

Through propaganda and professional training, the team of HGVs has increasingly improved their knowledge and skills in HGVs. Notably, up to now, 100% of the HGVs have been built and developed in villages/residential groups at the district level, ensuring quantity and quality. The province currently has 1,106 HGVs, with 6,598 HGVs. The HGVs are all people with good moral qualities, exemplary, prestigious, capable of mobilizing and persuading people to comply with the law, having a sense of responsibility, and enthusiastically participating in HGVs work.

Expanding good models and effective practices

Mr. Nguyen Thanh Son, Deputy Director of the Department of Justice, informed that thanks to effective implementation of the law, the work of HGĐCS has had positive changes, the quality of conciliation of cases has been improved. The total number of cases received for conciliation in 10 years in the province is 11,176 cases, of which, 8,988 cases were successfully mediated (accounting for 80.4%); thereby, contributing significantly to maintaining political security, social order and safety, building great solidarity in the community, reducing petitions and complaints, contributing to promoting the socio -economic development of the province.

“The implementation and enforcement of the Law on Mediation has had a positive impact on social life, creating a comprehensive, complete and solid legal basis for Mediation activities to become orderly, unified and effective. Notably, the awareness of Party committees, authorities, and leaders of agencies and units about the role and importance of Mediation work has been raised; thereby, creating a change in Mediation work, and improving the quality of mediation” - Mr. Nguyen Thanh Son assessed.

In the coming time, all levels and sectors will strengthen the propaganda and dissemination of the Party's guidelines, policies and the State's laws on mediation work to raise awareness of the whole society about the position, role and importance of mediation work in social life. Replicate a number of good and effective models and practices for localities to refer to and apply to improve the effectiveness of mediation work in the coming time. Promote the construction and management of legal bookcases in communes, wards and towns to have a source of documents for mediation staff.
