Scientific workshop to contribute ideas to the draft Government Report summarizing the law on implementing direct democracy

Speaking at the opening of the workshop, Associate Professor, Dr. Trieu Van Cuong, Deputy Minister of Home Affairs , said that the Ministry of Home Affairs was assigned by the Party Delegation of the National Assembly, the Standing Committee of the National Assembly, and the Prime Minister to preside over and coordinate with relevant agencies to develop a "Report summarizing the implementation of the law on direct democracy; proposing amendments, supplements, and promulgation of new legal documents to continue perfecting the law on direct democracy" to implement Resolution No. 27-NQ/TW dated November 9, 2022 of the 13th Party Central Committee on continuing to build and perfect the socialist rule-of-law state of Vietnam in the new period.

This is a very large and difficult task, with rich content and wide scope, related to many fields, professions, and many legal documents (Laws, Resolutions of the National Assembly , People's Councils at all levels; Decrees of the Government, Circulars of ministries and branches).

Deputy Minister Trieu Van Cuong suggested that experts, scientists, managers, especially representatives of ministries and branches: Central Committee for Mass Mobilization, Central Committee for Propaganda and Education, Ministry of Justice, Ministry of National Defense, Office of the National Assembly, Office of the Government and representatives of localities focus on discussing and contributing ideas to complete the draft report of the Government. At the same time, discuss and propose solutions, initiatives and proposals to continue to perfect the law on implementing direct democracy.

Presenting the draft Report, Deputy Director of the Youth Affairs Department Tran Xuan Hien said that the work of building and implementing grassroots democracy regulations, including the content of implementing the law on direct democracy, has always received attention and close direction from the Party and State in recent times; the legal system on practicing democracy has been gradually improved, especially the Law on Implementing Democracy at the Grassroots, which was passed by the 15th National Assembly, has provided specific instructions on the content and methods of implementing democracy in the direction of strongly promoting and expanding the implementation of direct democracy by people participating in the process of building and developing the socio-economy and international integration...

Agencies, localities, units and enterprises continue to amend, supplement and perfect the law on implementing democracy at the grassroots level and the law on direct democracy; internal rules, regulations, conventions and village covenants in accordance with the provisions of law and the development situation of the country.

The activities of the Central Steering Committee and many localities have seen innovations, especially in propaganda, inspection and organization of thematic conferences. Awareness of democracy and democratic practice of Party committees, authorities, the Fatherland Front, socio-political organizations, heads of units, cadres, party members, civil servants, public employees and people have seen many positive changes.

In general, the results of implementing the grassroots democracy regulations have made much progress and gone into depth. Among the three types of grassroots, the implementation of the democratic regulations is most systematic, qualitative and effective in communes, wards and towns; it is implemented quite systematically in the activities of state administrative agencies and public service units.

Representative democracy is promoted, direct democracy is expanded; the motto "People know, people discuss, people do, people inspect, people supervise, people benefit" is concretized in many fields at the grassroots level. The mechanism "Party leads, State manages, People are the masters" continues to be implemented synchronously, more specifically and effectively...

Speaking at the Workshop, delegates assessed that the draft Government Report prepared by the Ministry of Home Affairs was quite complete, elaborate, and had many contents, and had presented a picture of the implementation of direct democracy in the provisions of legal documents. The Report also assessed the advantages, limitations, and shortcomings that need to be studied and proposed for appropriate amendments and supplements; the Report was reasonably structured into 2 Parts, with forecasts, comments, assessments, and specific content proposals.

Mr. Ha Ngoc Anh, former Deputy Head of the Central Committee for Mass Mobilization, said that under the leadership of the Party and the direction of Party committees and authorities at all levels, the promotion of democracy at the grassroots level has been increasingly expanded, and direct democracy and representative democracy have been strengthened. However, the leadership and direction of the implementation of democracy at the grassroots level by some Party committees and authorities at the grassroots level has not received due attention. The awareness of responsibility of a number of cadres and civil servants, especially heads of agencies, units and enterprises, in building and implementing democracy at the grassroots level is not adequate...

Recommending the promotion of direct democracy in the election of deputies to the National Assembly and People's Councils at all levels for the 2026-2031 term, Mr. Ngo Sach Thuc, former Vice Chairman of the Central Committee of the Vietnam Fatherland Front, proposed to continue to amend and supplement the 2015 Election Law, regulations on candidacy, and more specific regulations on standards and profiles of candidates for the National Assembly and People's Councils, especially for full-time deputies, to select truly representative people representing the will and aspirations of the people to participate in state power agencies; at the same time, to overcome the situation of too obvious differences in capacity, professional qualifications, and work experience among candidates...

Concluding the Workshop, Deputy Minister Trieu Van Cuong acknowledged and highly appreciated the presentations, proposals and valuable opinions of the delegates attending the Workshop.

The opinions have assessed and affirmed that the construction and implementation of the law on democracy at the grassroots level in recent times has continued to be improved in the direction of promoting and developing direct democracy of the people participating in the process of socio-economic development of the country. Many legal documents have been issued with regulations on implementing direct democracy such as: election, candidacy; voting; dialogue; people's meetings, and residential group meetings, which have promoted the effectiveness of direct democracy. However, at times and in some places, there are regulations that are not clear and specific, so implementation is still limited.

Deputy Minister Trieu Van Cuong requested the Department of Youth Affairs to synthesize and fully absorb practical contributions from experts, scientists, managers and written comments from ministries, branches and localities to promptly complete the draft Report and submit it to the Minister for reporting to the Government.
