On the morning of June 16, with 450/459 delegates participating in the vote in favor, the National Assembly passed the draft Law on Teachers.
Presenting the report on receiving, explaining and revising the draft Law before the National Assembly passed it, Mr. Nguyen Dac Vinh, Chairman of the Committee on Culture and Society, said that after receiving and revising, the draft Law consists of 9 chapters and 42 articles, 4 articles less than the draft Law submitted to the National Assembly at the beginning of the 9th Session and 8 articles less than the draft Law submitted at the 8th Session.
Overcoming the situation of profiteering from extra teaching and learning
There are suggestions to add the concept of “extra teaching”; regulate the management of extra teaching and learning to improve the quality of teaching and learning in schools; assign the Government to develop a set of regulations on extra teaching and learning and prohibit teachers from giving extra teaching in violation of the law; propose to prohibit teachers from giving extra teaching to students they are directly teaching.
Regarding this content, Mr. Vinh said that the content on extra teaching and learning has been specifically explained in Report No. 1256 dated April 17, 2025 of the National Assembly Standing Committee.
The management of extra teaching and learning is within the scope of the Law on Education and will be specifically regulated in the implementing guidance document.
The draft Law does not prohibit extra teaching and learning, it only stipulates that teachers are not allowed to force students to participate in extra learning in any form in order to limit and overcome the widespread situation of extra teaching and learning and profiteering from extra teaching and learning activities.
Currently, the Ministry of Education and Training has issued a document regulating extra teaching and learning, which clearly states that teachers are prohibited from giving extra lessons to students they are directly teaching.

There are opinions suggesting clearly defining the basis, principles, standards, and conditions for recruiting teachers; proposing to remove the requirement of pedagogical practice in recruiting teachers; there are opinions concerned about assigning the authority to recruit preschool teachers and general education teachers to educational management agencies, decentralizing to the heads of educational institutions.
According to Mr. Vinh, teachers in public educational institutions are civil servants, so recruitment must comply with legal regulations on civil servants. The draft Law only stipulates some specific requirements in teacher recruitment such as recruitment content based on professional standards, recruitment methods must have pedagogical practice...
Regarding the authority to recruit, the Government and the National Assembly Standing Committee agreed to give the education sector the initiative in recruiting teachers. Regarding the authority to recruit preschool and general education teachers, taking into account the opinions of delegates, the draft Law was revised to be implemented according to the regulations of the Minister of Education and Training.
There is a proposal to combine regulations on mobilization and transfer of teachers; consider the condition of requiring the consent of the receiving educational institution when transferring teachers.
Regarding this content, according to Mr. Vinh, mobilization and transfer are two different policies. Mobilization is carried out by competent authorities to meet the requirements of the industry's tasks, requiring compliance from individuals and related organizations. Transfer comes from the personal wishes of teachers, requiring consensus from the place of arrival and the place of departure.
Teachers' salaries are ranked highest.
Regarding salary and allowance policies, there are concerns about the regulation that teachers' salaries are ranked highest in the administrative career salary scale system; it is proposed to replace it with regulations on building a separate salary table for teachers; clearly stipulate the starting salary for teachers; review regulations on teachers' salaries applicable to autonomous educational institutions to ensure feasibility in terms of financial resources.
Regarding this issue, according to Mr. Vinh, teachers in public educational institutions are civil servants. Therefore, teachers' salaries are implemented according to the administrative career salary scale commonly applied to civil servants.
The draft Law stipulates the principle that teachers' salaries are ranked highest in the administrative career salary scale to institutionalize the Party's policy in Conclusion No. 91 of the Politburo on continuing to implement Resolution No. 29 of the Central Executive Committee on fundamental and comprehensive innovation of education and training.
The detailed regulations on salaries and allowances for teachers, including coefficients, starting salaries, salary arrangement mechanisms for teachers in autonomous educational institutions... will be specified in detail by the Government in the implementation guidance document to ensure flexibility, feasibility, correlation, and fairness with civil servants in the political system.

In addition, there are suggestions to revise regulations on teachers' salaries to ensure fairness between teachers in the public and non-public sectors. Mr. Vinh said that the draft Law submitted to the National Assembly at the 8th Session has regulations on salary policies applicable to non-public teachers, ensuring that the salary is not less than that of public teachers with the same training level and title.
However, many delegates said that this regulation is unreasonable, violates the principle of voluntariness and autonomy of non-public educational institutions, and could lead to an increase in tuition fees and other surcharges, affecting the policy of socializing education.
Incorporating the opinions of National Assembly deputies at the 8th Session, the draft Law was revised in the direction that the salaries of teachers in non-public educational institutions are implemented in accordance with the provisions of the law on labor.
Mr. Vinh said that in reality, to attract good teachers, many non-public educational institutions are willing to pay salaries and incomes much higher than the current salaries of teachers in the public sector with the same qualifications and titles.
Therefore, to ensure the autonomy of non-public educational institutions in paying teachers' salaries based on practical conditions, the National Assembly Standing Committee requests to keep the provisions as in the draft Law./.
